Owner Operator Min Mileage Requirement

    I own a Trucking Company and have a few Owner Operators that now only work 3 days a week.
    We pay 80 percent of gross pay.
    Net Pay After Fuel is deducted is $1,500.00 to $2,500.00
    I own the new Van Trailer which he uses and do all fuel tax and book the highest paid loads possible. Provide a fuel card which is deducted from his pay.

    Question...Do other lease on companies require Owner Operator to work 5 days a week?

    Should there be a minimum work week / month requirement?

    I'm sure some companys do while others don't. As the owner you can set minimum limits bu be prepared to lose some drivers

    You can put in your contract whatever you desire, as long as it is legal to do so of course.

    I hope you are also deducting for insurance and plates, rather than it come out of the 20% take.

    Part of being an owner operator is working when you want. That also goes with work hard when it's good and stay home when it slows. At least that's what most smart people do. If he is happy with his 1500 to 2500 per week settlements why should he work more? If his truck is paid for maybe he never wants to buy a new one and when it's done he is quitting. That's his business. If he has if figured where 3 days a week is a comfortable earnings and work/life is balanced... Who is anyone to say otherwise..?

    I don't want to lose drivers ...but I need a min amount of gross dollars per week to cover my fix expenses.

    Your expenses are your problem.

    You have a few options it looks like.
    You tell them your cut is higher than it is now. Or you convince them to work more. Or you find more owner operators. Keep in mind the first 2 options may cause the guys you have now to tell you to go fly a kite. I would love to have an owner operator work whatever amount he wants for 20% off the top. Doesn't cost me any extra out of pocket.

    I'm leased to an outfit, and they want 4 days a week minimum out of us. I normally will work five or six days. I have taken the past two weeks off to work on the truck. They want me back at work... But, the truck comes first. The issue is covering the costs, this outfit picks up everything for us. We just pay for our fuel, taxes and plates, they take care of everything else.

    I would explain to these guys how it is, and let them take it from there. If they cannot perform, fire them.

    Good thing is, he can't fire them. They aren't employees. He can. however, end the business to business relationship with them. The thinking needs to change to reflect that (if the op is, in fact, thinking of them as employees)

    To the op, I would suggest talking to them and letting them decide if they want to work with you. You could offer to let them pay the trailer payment, but offer a few more % in pay. I really dunno, but if you arn't making money you need to change the contract on the next renewal, and not before.

    Fire them, cut them lose, the end results are the same. If they are not performing and costing the owner money, something has to change, contract workers or not.

    You can NOT hold them to a minimum amount of time working, they are contractors under the law and can refuse work without retaliation.
