FMCSA is supposed to come out with a addendum to the HOS rules clarifying PC, as you can ask 10 different inspectors today if a situation is OK or not, and get 10 different answers. About the only consistent aspect today that most agree on is that your starting and ending point of a PC "trip" must be the same point before resuming lines 1-4 activity on your HOS. You cannot "advance your position". I hear a lot of "must be unladen", which is true because the rule states that, however what about hauling expedited freight with a straight truck? Most inspectors know this makes no sense to penalize the driver in this situation even though the rule says otherwise. The PC rules need a serious update and rewrite for clarity.

No seriously... I think this is one area where "everyone knows" it's not allowed, but it really is.
I ask as I just went over 395.20 to 395.38 and did not find anything. Everything I found that talks about edits from the admin portal does not mention drive time.
I could have missed it, and I'm willing to learn, but it would be nice o know where it is stated, if in fact it is.Last edited: Jan 27, 2018

FYI if you are assigned to a load they can't allow off duty driving unless you have placed your load in custody of someone else like shipper or receiver lot. For obvious reasons, I never show having an assigned load until I am physically under the load. Company policy usually covers this area.Last edited: Jan 27, 2018
