Just because one spent 20 years hitting one’s self in the head with a hammer doesn’t make one a carpenter.

Just curious, but something doesn't make sense here. So you are saying he unplugged his ELD so he could drive 900 miles to be home "on time"?...... what's that even mean?

No offense, but that makes absolutely no sense. So what really happened?

    SAR Thanks this.

It took him longer to get loaded than he expected. It was not mathematically possible to make it home within the hours of service. So he took it upon himself to disconnect the ELD so he can drive all the way through 20-some hours to get home on time like he told his wife he would be. I thought that was pretty clear.

Was draining the tank last night and a Western Distress driver comes thru the tanker bay door - asks about the location of Shipping & Receiving for dry van.

'Bear right & turn left around the back rowof vans, halfway down the row on the left there's a large opening - the staging area - pull in there and shipping will be right in front of you.'
Literally, LITERALLY, by the second 'left' he was thumping the middle-back part of his head with his right hand.
I assure you, I took a step back just in case schizo / autistic driver got too overwhelmed by simple information.

So he was up all day, drove, then waited around to get loaded for several hours, THEN he was gonna drive 900 miles home?

Lol....did you even drug test this guy before you hired him?

    SAR Thanks this.

Once I had his drug test results I seated him in the truck the night before he loaded. He drove 3 hours to get loaded and that took him longer than he anticipated.
When I confronted him over the phone about disconnecting the Eld, he abandoned the truck with the load in Southern Illinois. At that time is when he notified me that he had the upcoming Court appointment for Monday that he did not disclose in the application or interview.
So yes he was fired for falsifying his logs, abandoning a load, and falsifying an application. And trashing out the truck was just the icing on the cake.

    This a newer California law:

California Government Code,12952. (a) Except as provided in subdivision (d), it is an unlawful employment practice for an employer with five or more employees to do any of the following:
    (1) To include on any application for employment, before the employer makes a conditional offer of employment to the applicant, any question that seeks the disclosure of an applicant’s conviction history.
    (2) To inquire into or consider the conviction history of the applicant, including any inquiry about conviction history on any employment application, until after the employer has made a conditional offer of employment to the applicant.

Not concerned I don't hire out of California and I do not have five or more employees. In fact I don't even do business West of Denver Colorado.

It was a Saturday afternoon, nobody was in the office.
Not an easy decision what to do, had just arrived from Germany, Temporary Foreign Worker Visa in my passport to work for this company. Had spent a lot of money to be in Canada, starting a new life.
Was on the road with a Canadian driver for two weeks, came back to the yard and should take this truck for one trip to Newfoundland.
And then this mess. I bit the bullet, cleaned out that truck and made my trip. When I came back I got assigned my truck, after a short inspection I told them if the truck is not detailed, I quit.
They detailed the truck and I moved in. Several months later I got a newer truck, same story.
The boss himself and another driver cleaned that truck before I moved in.
After one year I quit and moved from P.E.I. to Alberta.
Started a new job in Lethbridge, but they had no truck available there. They drove me to Calgary where I should get my truck. My wife and all of our stuff was in the van, we arrived in Calgary, I looked in the truck and called my new boss. Told him I go back to Lethbridge with the other driver and when he has a clean truck for me, he could call me. Took a few days and I got a very clean truck.
The problem was, companies abused the system with temporary foreign workers, you could only work for one company, if you wanted to switch you needed a new visa, not so easy.
I switched two times, had three companies in Canada before I got my Green Card and moved to the States.

I will never forget this one day, I was so mad but also desperate.
The name of the company is Bulk Carriers P.E.I. They forced foreign workers to run outlaw, to run to the States with overweight.
A lot of drivers from Britain, Germany and other countries had to bite the bullet or to go home.
The second company I worked for was H&R Lethbridge AB, they were not better.
The only company which was fair and respected the drivers was Watt & Stewart in Claresholm AB, this was my last company in Canada, before I moved to the States.

I could write a book about my experiences as a foreigner in Canada, but nobody would like to read it.
I'm just glad that I live in the States now, a few more months and I finally can apply for citizenship, then my wife and I will be American, we will drop our German citizenship.
