File again, and then take it to court to collect from the party responsible for paying for the load.

    Remember this important thing

The factoring company is one of the safeguards you have in risk management. If they say no, then it is no.

This is one thing that I hate, brokers should not be allowed to double or triple broker a load. The fmcsa needs to put this in regulation. The only exception I can see is if there is a full disclosure involved.

File again with the bond co.
Weather the broker got paid or not is totally not relevant.
your contract is between the broker and you and nobody but you.
If the broker didn’t get paid does not effect your contract unless it reads I don’t have to pay you if I don’t get paid.

I remember rejecting a load of which the rate was already agreed on because the set up paperwork that followed the rate talk, stated that they would pay me only after their customer pays them first. I went to DAT reviews and there were some reviews complaining exactly about that. Their excuse: "Our customer hasn't paid us yet. Please refer to the contract" I wish I wrote down who their were... To me it is unacceptable.

We are here because drivers are spineless.
Driver is not a shipping department clerk to pick the product, put it on the pallet wrap it and load it.
Driver is not FDA inspector to check quality.
Driver is not AG specialist to recognize what kind of apple or pomegranate is in the box.
Seal the trailer and that all.

Many places will not allow Drivers on their docks though.
