File a claim on his bond that's the first thing you do
-
Already did that they denied my claim there excuse was they dont know if there client which is this broker got paid because it was triple brokered . makes no sense then they asked why is ch robinson showing as the carrier . which in fact there the broker
-
File again, and then take it to court to collect from the party responsible for paying for the load.
Remember this important thing
The factoring company is one of the safeguards you have in risk management. If they say no, then it is no.
This is one thing that I hate, brokers should not be allowed to double or triple broker a load. The fmcsa needs to put this in regulation. The only exception I can see is if there is a full disclosure involved.DSK333 and easytopleez33 Thank this. -
Thank You
I didn't know u could file twice. right now i am seeking a good trucking attorney , or what would type of attorney would i be looking for ? -
@truckersjustice any advice?
Also any contract lawayer will be able to help. -
Weather the broker got paid or not is totally not relevant.
your contract is between the broker and you and nobody but you.
If the broker didn’t get paid does not effect your contract unless it reads I don’t have to pay you if I don’t get paid.TallJoe Thanks this. -
I remember rejecting a load of which the rate was already agreed on because the set up paperwork that followed the rate talk, stated that they would pay me only after their customer pays them first. I went to DAT reviews and there were some reviews complaining exactly about that. Their excuse: "Our customer hasn't paid us yet. Please refer to the contract" I wish I wrote down who their were... To me it is unacceptable.
DSK333 Thanks this. -
Driver is not a shipping department clerk to pick the product, put it on the pallet wrap it and load it.
Driver is not FDA inspector to check quality.
Driver is not AG specialist to recognize what kind of apple or pomegranate is in the box.
Seal the trailer and that all. -
