So long as it is true, former employers can say anything they want, even why you was fired. My wife's company was sued last year by a former employee after she tried to get another job working in a gas station. She was fired because she was stealing cash while making her safe drops. She would show a drop for $100 cash, but she was taking $120 from the drawer. Some how, she was palming the extra $20. For months her drawers were coming up $80-100 short once a week. She finally slipped up and the camera caught her dropping one of the notes on the floor. When the new employer called for verification, they told them why she was fired and could even back the claim up with police reports and video. She Tried to sue and ended dropping the suit because the employer threatened her with filing charges for theft

One more point. You can not hide inappropriate or illegal past employment behavior using privacy laws. How this ends depends on the new prospective employer. If they don't a rats patoot your ok I guess. If they do care and you block their investigation of your past by refusing to sign releases you are not going to get that job. It is just that simple. You have NO grounds for a lawsuit if the information is true by the way. If I were on my laptop I would post a link to this. I might still later.

I recently sent out pile of applications to various carriers. I kept getting texts from Ten Street that such and such company had pulled my MVR, my DAC, something called CDLIS or whatever... apparently I have no cdl experience or approved cdl schooling on file. Just a clean, accident free cdl. Which means that Swift didn’t even report my time there to Hireright. Those same companies will then have to call past employers to verify my time there. When I talked to Swift about it, they said all they will confirm is length of service and failed tests. Maybe if eligible for rehire. But if I wasn’t eligible for rehire, it would be on my DAC.
