also, since he hasn't any paychecks, (i assume all monies paid him are up to date), you can just fire him. in some states (like mine), if an employer fres a worker, that employer has 24 hours to pay up all monies due.

THAT driver you got is refusing to work. Plain and simple. Fire his ###.
Whatever the problem, shop gets to fix the first tractor and make it legal for highway use and sign off on it. But not until the #### thing is fixed.

You could hand me a chain drive and Im going. If you know anything at all about those things, you will understand driving and riding in say a 1924 mack open cab chaindrive is like riding on a block of stone.
I AM HAPPY to celebrate that you found the problem with the first truck that broke and are getting it fixed.
I am VERY SAD that you hung on to this one lazy SOB who is filled with his own pride not to stoop down and collect a tractor you managed to dig up to run that load. Fire him.
Im done with this thread because I am repeating myself. I know that I should go away and see if you did get rid of that leech and get your business moving again. Penske is not God. It is not the be all , end all, In fact I pity you having to depend on Penske. Any man willing to lay around for weeks on end and try to collect a wage while at home is lazy in my eyes. You should let him go for that reason alone.

Did you offer to pay for a hotel and a bit extra for the inconvenience of having to buy all food and drink as there is no room to take any?
Or were you going to make him loan you the money for hotels, i.e. reimburse him? -
