The truck had insurance, just no workers comp .
Had driver got killed with out wc all cost would be on the family, in my state wc would Pay funeral expenses plus 100k to wife and about 600 a week for life.

You are partly right. But before the live stock owner can be held liable you must prove willful neglect. If a farmer has his fence in generally good repair you will lose that arguement. As long as ####### kids think its funny to sneak onto a farmer's peppery and chase his horses and cows, it is not possible to guaranty they will never break free.buddyd157 and lovesthedrive Thank this.

Well they have a good idea of who owned the horse,and the alleged owner isn’t cooperating (probably because he/she knows that the horse caused a major wreck and they’re screwed) and Florida probably doesn’t have open range laws like Texas does,not with all the endangered species of wildlife they have to contend with. Never mind the fact that the first truck that struck the horse was damaged too so that’s twice as much trouble to deal with.
I’ve been around the Lakeland/Auburndale/Haines City region quite a few times picking up Coca Cola loads out of the Auburndale plant, and most of the farms,if not all of them in that particular area are fenced in.Last edited: Apr 27, 2018

and if his fences were in good repair and the animal jumps the fence, or some punks mess around, why should the farmer still be held responsible?
it sucks to be that driver for not having his own insurance. and who's to say that the farmer HAS any insurance as well...???
again, good luck in suing that farmer.
heck if that was a valuable horse, maybe the driver can be counter sued for killing it...gotta watch out these days for reversal lawsuits... -

good luck........someone could have illegally taken it off the property as well, as in stole it..
falls on the dumbarse driver for not having any insurance. and he had been been 100% legal as well with his speed, ellog (or paper logs) as well.
further, i am not finding anywhere right now, that farm insurance is required BY LAW in Florida.

prove it, show me a policy, i can't find one, then prove to me the horse came from a farm, and not a private residence, as well.
tuff luck for the driver, putting off HIS responsibility to have insurance.
