Cell Phone Citation - anyone ever got one - what was the ticket

    The company I work for makes us sign a piece of paper that has the specific fmsca wording on it regarding this... And it states that I understand that I can be fined something like $2400 and the company can be fined $11000. It also states that if I do get caught using a handheld device I will be immediately terminated and that the company has a zero tolerance policy for such behavior. And that I will never be able to work for this company after such an offense... I'd say the driver in question would have been better off and $$$ ahead to have stayed at home for 2 weeks than to have been using a handheld device while driving... I hope he has other skills besides driving cause I don't know of any company that will hire him or an insurance company that will insure him in a CMV. His career just changed... Forever.

    And it's a big hit on the companys csa score too. Goes under the unsafe driver category.

    Update:

    The driver is getting a lawyer to try to reduce to a different offence.

    Issue i see is at that trucking company is that their elogs are on their cell phones - the driver was at a stop light about 2 miles from their shop and he was looking at his hours to see what he had left for the week.

    I don't know why any elog app is allowed on a phone device anyways.

    Wheew! Points on your license and losing your job should be enough of a deterrent, not to mention one HELL of a fine on top of that.

    EDIT: Just saw the update. I have to ask though, if you're only 2 miles from the shop.....why not just check to see "how many hours are left" when you park? If that's truly what he was doing, just waiting to drive that extra 2 miles would of saved a LOT of headache. I don't really see how that story will get the offense changed. It still involves taking your eyes off the road to stare at/do something on your phone. No different than if you whipped out your phone to check your Facebook feed at the light. It might not be texting, but it's still not a smart move.

    I don't want to sound like an idiot...but I find that hard to believe. Stopped at a light? Heck I've sat next to cops at a light on my phone while they were on their phones!! Where was this again?

    I actually had a set up like that. Everything was on a tablet. Kept it on the passanger seat. Ran thru the portable scale in Mobile. I was in the left lane wondering why all the trucks were going in the rest area. The officer conducting the inspection didn't like the fact that the tablet wasn't connected to the truck. And the fact that I missed the scale. He kept me long enough to run out of time than gave me a HOS violation.

    so to understand the rules, is this a specific Cell Phone rule or also to any device (ie: elog) usage while driving?

    Yes,

    He should have waited until he got to his shop.

    BigBob - why would you take the chance looking at your phone at a stop light with cops next to you?
