Some states do need PC when it comes to a traffic stop with a CMV. An inspection station or port of entry would be a different scenario. It’s why you read on here the officer notes the reason for the stop in the inspection form whether it’s speeding 1-5 warning, or improper lane, etc just to show the reason for the initial stop.

 

I know either they don’t need PC in TN, or the abuse the law badly.

 

I agree that Tn is sketchy, especially their interdiction units, with how they enforce the laws. I know when Brownsville scales were being rebuilt, they would sit out on I-40 Every truck pulled over did have a violation though, and 99% of the time it was tandems all the way to the rear or missing mudflaps.

 

Under the federal regulations any DOT cop can inspect any commercial vehicle in service. They don't need probably cause. That being said, since DOT cops are employees of the state, and usually law enforcement officers of the state, the state certainly can make them follow more restrictive rules.

 

No but if you stopped again in a same state within some period of time it will double. Time frame depends on state. Usual one year

not picking, your right they can pull you over anytime they choose, if you push they will give you a reason you may not like

At least one trucker is fighting these silly warrantless inspections..hopefully the dot will soon have to go thru the court system to get a warrant to inspect your truck..
