    I'm gonna weigh in here. I have an inside track to Arkansas law. Last week a DWI was dismissed because the state trooper wrote a less charge ticket along with the DWI as the probable cause to make the initial traffic stop.


    However any proseutor worth their sand can prove a bobtail truck weighs over 5 ton. Does not excuse shoddy police work which is where the opportunity lies. It's ginna be up to the Judge.

    To the OP last thing you wanna do is admit even your company warned you. Laziness will get the book thrown at you

    I'm spending a lot of time today on other websites with this reply. Without actually putting eyeballs on the ticket and see the charge I can't answer. It might just be a standard set overweight ticket no matter what that amount is.

    I have no idea...but guessing a city or county ordinance, because it doesn't really match up with the state penalties...although with the OP stating "at least", it very well could be a state violation.

    Yeah proving it’s over 5 ton is easy, establishing a gross to base the fine was my question.

    Your right I was thinking it's failure to follow truck route even though I read it was a 5 ton weight limit road. 2 totally different animals

    I would think, if nothing else, they could go by the weight stated on the BOL.

    A lot of the main roads in Chicagoland radius only allow you to be on designated routes for so many miles, not the whole length of the state either.

    Provided the BOL was based on a certified scale and not just a the declared weight from the shipper, we know they’re alway right.
