30 min break rule

    Do you or do you not have to take a 30 minute break

    The rule states
    Do not drive for 8 continuos hours

    But, a few people have told me that dot likes to see it before the 8 hour mark of your shift whether it's all driving or not

    You can take it at the 7:59 mark..
    They can't say a thing about it.

    If you're not driving... you're not required to take if at all.
    You just can't drive until you DO take it.

    I believe it states you cannot drive after 8 hrs w/o a break, whether it is driving or on duty time or a combination.

    I wouldn't bet on it though.

    I'm new to elds not driving
    My 8 hour break clock restarts after on duty or off duty time after I have logged drive time

    8 hour clock starts as soon as you log on duty.
    You now have up until 8 hours to drive before you have to take a 30 minute break, if you want to keep driving.
    30 minute break is only due to driving.

    And DOT could care less when you take it, as long as you play by the rules.

    I cheat it and take it while at the dock. I don't have time to sit somewhere for 30.

    Here is the exact regs.
    (ii) Rest breaks. Except for drivers who qualify for either of the short-haul exceptions in §395.1(e)(1) or (2), driving is not permitted if more than 8 hours have passed since the end of the driver's last off-duty or sleeper-berth period of at least 30 minutes."

    Basically it means that 8 hours after coming on duty or since last break of 30 minutes one cannot drive.
