The FMCSA's own data (see the MAP-21 ule making publication) clearly states that HOS exempt ag haulers have lower accident rates that the average OTR operator.

IF (big IF) it was a hazard, the insurance companies would jack the rates way up before the government ever would do anything about it. And they are not. My rates are lower than OTR rates right now.

 

Other than that pesky law that says you have to log it as on duty:

(9) Performing any compensated work for a person who is not a motor carrier.

 

Check the NTSB website. Ag wrecks are up not down.
Specifically cattle, pig, and milk haulers.

And yeah I know the low rates folks are hauling raw ag items for. I also see and hear all the folks claiming the exemption when they do not qualify. Another year or two of audits after wrecks, OOS for folks claiming it when it does not apply and they will react be making it for harvest of specific commodities inside 100 miles as it should be.

Within a hundred miles it doesn't matter what you're hauling you don't need a logbook period last I heard.

 

If you are talking about the time card exemption there is actually 3 criteria...(plus some paperwork carrier requirements, mostly simply keeping a "timecard" of hours worked.
1. 100 air mile radius
2. Start/Stop same location
3. 12 hour days max

 

You know what's even siller? So you restore an old Mustang and sell it. All that time should have been On-Duty. Or if you make those silly well yard decorations in your spare time as woodworking is relaxing. Sell them at a craft show and your relaxing weekend hobby now is all on-duty.

 

That’s right. All these scenarios and legal interpretations. I don’t believe PA has a special rule. I could have fought and won, I believe it just wasn’t worth it.They shut me down after 2 hrs of me disagreeing with them.Finally I lost my temper and shook my finger in their face telling them they should be out protecting the public instead of shaking me down.I wasn’t about to admit to a log book violation I was off duty and didn’t have a Load thus unladen as the regs read.It felt good to tell them off.But I got a ticket for falsifying Logs$500 went to court settled for $50 not current.The Judge was a magistrate.Basically asked cop why I was guilty then agreed. I could have refused then appealed. I would probably need a Lawyer to win.So I let it be at that. It was worth it still to me anyway as these cops were dirty.Telling me to go ahead and bobtail anywhere I wanted.After putting me out of service. I sat for 10 hrs also noticed the same vehicle 3 times checking up on me. I asked them in court if they recalled saying that. They answered why would We tell you that?I said gee I wonder .

 

See, what you have in your mind is wrong, which effects all your attitude. There is no regs on PC. There is guidance, but that's all it is. Guidance. If the officer doesn't agree with it, it doesn't matter what the driver thinks. The driver is wrong, because it reverts to the actual regs of requiring to be on duty.

 

The so called regs that is the Fmcsa regs are an agreed upon by all parties set of guidelines that are held up by Law period. Read them yourself all available on line . Read the regs all the way to what’s called “the final rule” which usually includes intended use and enforcement.Example off the top of my head “Is an unsigned log still considered Legal : answer Yes
