Legal to nearest scale even when crossing state scales?

    Hello,
    I have been absent from here for a while but this is the best place for DOT info that I know.

    One of our drivers left the shipper and headed to the nearest cat scale (of any scales available). Doing so had crossed an Illinois state scale. Loaded at Manteno IL, rolling I57 N to Monee to scale.

    Well, reportedly He/She was 200-300 overweight on tandems (dispatch could not remember the exact number) and was hit with $545 fine!!!!

    I though we were legal to the nearest scale. How else are we supposed to know if we are legal or not? Safety department says, "It is subject to each state. Go to the nearest scale that does not cross a state scale."

    My question is, Can anyone find written in DOT regulations where we are free from harm (fines) leaving shipper and rolling to nearest scale to check weights.

    I have not posted any videos in quite a while. The crazy is so common that it is not exceptional any more.

    Nope: you need to be legal weight regardless of how far away the nearest scale is. No exceptions..

    Legal before you leave the property and hit the streets.

    That's a lot of money though for such a petty overweight. Dayung


    Mine was $50 for 1500 over on tandem. Home state.

    $300 in oregon for being 2500 over on bridge.

    That sound fishy even Illinois will give you 500 pounds on the tandems and just make u slide and get legal. Must caught the wM on bad day

    I just found this online. It sounds like the driver may be underestimating the number of pounds he was overweight. My guess it's more like 3,000 instead of 300.

    According to 625 ILCS 5/15-113, the amount of the fine for an overweight truck shall be calculated in accordance to the schedule below (note that additional court costs and surcharges are often added to the amount of the fine). Please note: overweight fines in the City of Chicago can be found under 9-72-080 of the Chicago Municipal Code.

    If the truck is overweight by:

    Up to 2,000 pounds, the ticket shall be $100.

    Between 2001 and 2500 pounds, the ticket shall be $270.

    Between 2501 to 3000 pounds, the ticket shall be $330.

    Between 3001 to 3500 pounds, the ticket shall be $520.

    Between 3501 to 4000 pounds, the ticket shall be $600.

    Between 4001 to 4500 pounds, the ticket shall be $850.

    Between 4501 to 5000 pounds, the ticket shall be $950.

    200-300 pounds is only one hole on our trailers! I was pulled in and full stop weigh on a scale, 1500 overweight on tandems way back in my day (7 years) in IL but was green lit, I assume, because I was only 72,000 and tandems very forward that the WM assumed I was headed to a cat scale to adjust them. Maybe this driver was being a D-wad and they slammed Him/Her?

    How are we to know if we are legal if the shipper does not have a scale?
