Other truck drivers are buying beer, should I report them?

    Here is a he big question.
    So the driver had an alcoholic beverage.
    Did not drive under the influence of said beverage.
    Acted reasonably responsible.

    Are your corn flakes any less crunchy in milk because of it?

    There was a driver pulled up in one of our terminals , started throwing all open beer cans away in the trash @ the fuel island/inspection bay... All the mechanics just looking at him like really dude !?

    Yes, I know, I also posted this myself earlier today. However, there is no specific language pointing out this applies to private property. The way I interpret this is having alcohol while on a public road. This is what really frustrates me sometimes with most all of the CFR title 49. I also find it a bit odd that there is no regulatory guidance on that section.

    On private property, generally the LEO's do not have authority unless your operating under the influence. If I was parked in a truck stop I just would not answer the door. There's no law requiring you to leave the sleeper and answer a knock at the door. Off Duty by definition: relieved of all responsibility for the equipment and/ or the load. Bang on my door and I see a LEO I'm going bak to sleep

    Ever hear that old joke where the Navy Chief gives his coffee to somebody and says hold this and watch this (redacted)? I can beat that. I once saw a guy moving to a new truck carrying warm beer still in 12 packs from one tractor to another one. What was so funny was one of the safety critters was walking out with another driver to do a driving test! yes, he got caught!

    Right there it doesn’t say anything about possessing or consuming alcohol in a parked cmv.

    It's like opening the front door if they knock, a couple of days ago here at the house I hear the bing bang bang of a rude loud knock at the front door, So I went out thru the garage and ask the cop what was up, he wanted to know why I did not open the front door, I told because I did not have too, and my lawyer has advised if you want to know anything else call him, and gave them the card.

    The way I figure any cop is that it is there job to take any and all information to try and put you in jail, so the only safe thing don't let them see, smell or hear anything. And you have the right to remain silent, use it. He also ask for my ID so I ask him what crime he believed me to have committed, he said no crime, and insisted I had to give him ID, Well his sarg when he arrived told him, You can't bang on someones door and demand ID unless they are believed to have been involved in a crime, He apologized and they both left.
    Still don't know why they were here, Don't really care. They haven't been back.
    So I believe the right to be free from unreasonable search and seizure extends to your living quarters in the truck. And no I'm not a lawyer but I do use them from time to time.

    Well, If the engine is idling and you've been drinking, if you answer the tap tap tap at your door your going to have a bad night.

    Agreed.

    Solution: Only answer the tap tap tap when on duty and sober.

    When off-duty and #### faced, roll over and play dead.
