    No federal laws prohibit a Properly credentialed LEO from performing an inspection at any time.

    It is unfortunate that it can be done. This should be changed.

    Even the CVSA has put out new guidance on the subject. They say not to bother legally parked vehicles. This was in overdrive read here

    Just to be clear ,they were pulling in trucks off the highway also ,they had their portable inspection signs out on the highway ,but this should definitely not be happening in the middle of the night in a rest area.Some clown dreams this crap up ,I can just imagine the conversation " let's roll in they're at Midnite,and really get the jump on them!" Like they're busting some outlaw gang instead of the hard working ,tax paying people that pay they're $100k salaries,and yes it is a six figure job with overtime.Its like they write their own rules and justify what they do under the "it's about keeping the highways safe!"
    When it's really about revenue,justifying they're paychecks (overtime ) and getting to play cops and robbers in they're stupid looking jumpsuits. I've beat them in court 99% of the time when getting stupid unjustified tickets ,but they still win because they got to write that ticket to look like a hero,they got to F%#% with you the day you got the ticket and you had to lose money while going to court to fight the ticket,while they never lose a dime ,so who really loses,we do. Some of them are okay,and I've actually become friends with some,but some are soul less trolls who should never have been allowed a badge and gun and should be back at McDonald's working the fryer where they came from .

    Pretty much sums up all law enforcement, but be patient someone will be along and tell you if you have nothing to hide then.............

    I thought there was a rule somewhere that they can't inspect you if you are off duty.

    CVSA updated their guidelines last year to not disturb drivers parked legally while on their breaks. If there were drivers parked at the rest stop illegally, then yes they would still wake them up, inspect and tell them to move.

    The guidelines also state that if you are directed to move by the DOT, it doesn't interrupt your 10.

    Sounds like they "just" used the rest area as a pop-up scale, which is a whole lot different than rousting drivers out of bed to perform an inspection.

    thats my biggest complaint about running the southern tier through NY. the ##### dot inspections at the rest areas are so over the top. And they run them at all times of night.

    No they should not conduct or try to force a driver to comply if they are off duty/sleeper.
    I had a ADOT in Eloy Az ask me for my about my hours of service while I was walking toward the restaurant, He said they were investigating an accident, I told him that I was not required to give him access to my ELOGS since I was not in the truck and not required to do so off duty, explaining to him relieved of all responsibility. He just shock his head and went to bother some other driver.
