What Do I Charge?

    I personally don’t think 4 flatbed loads of block is doable in 15 hours even if the length of haul is only 45 miles, but at least he doesn’t have too far to go if he does wind up getting delayed and has to cut himself off.

    And, if he’s done by 4:00 Saturday afternoon, he should have a fresh 70 by 2:00 Monday morning.

    The op running a CMV without insurance, and missing all the requirements to actually drive the companies trucks. Drug tests, driver qualification files, etc.

    Everyone is focusing on HOS, but that's the least of the issues. He needs to either be an employee of the company (even a 1099 will give him some protection, but it's far from legal) or run under someone's numbers.

    If something happens while he's driving a CMV that he never should of been in to begin with....
    Is going to jail very, very unlikely, sure.... But it can happen if he never should have been there to begin with.

    Now if he does get employed and get all the required paperwork, insurance, drug pool, etc then yes, he's golden.

    Again, I’m not understanding how that is an incarcerable offense.

    Also, since when does a driver driving a truck owned by somebody else have to concern himself with whether or not the truck is insured?

    Got paperwork proving my employment by contract and coverage by his company's insurance. Made some money for a W2 to make it legit, but most of it was cash so tax man would keep his hand out my pocket. I found a concrete plant closer than he did so I saved him so fuel money. Plans on running me again in the future for these short runs.

    Didn't run logs due to total A to B distance being less than 30 miles and got back in time for dinner.

    Regarding your last comment, I'm in the middle of suing a company, their driver and codriver. Although there was an insurance certificate in the truck, turns out only part of that company's fleet is actually insured. We've just taken the first deposition. My lawyer advises it will likely be split liability, with the driver and codriver on the hook for somewhere in the neighborhood of $10K and the company covering the balance plus punitive damages. We expect them to settle.

    Why is the codriver named in the lawsuit? Because he had a CDL and was logged in the sleeper berth. The driver had a permit, not a CDL. The idiot nearly totalled my truck, when I was parked at a truck stop.

    Any company driver should make sure the truck they are driving is insured. Otherwise plan on at least lawyering up. It can get expensive, in money and time.

    I think your splitting hairs. You are suing for damages on private property. Tell me what law was broken.
    Then tell what control a driver has over the company's insurance status. In the case of an accident, yes the driver can be drug in but that can happen no matter what.
