I dont think there is a written rule but wouldn't DOT rather have you parked legally than doing a 10 hour break on the side of the road? My incident today was an honest mistake and ignorance on my part. I would think they'd be more lenient to you violating 2 minutes if you were stuck on the interstate vs what I did today.

And Ray, I'm not really saying what you did was wrong. Crap happens sometimes. It really is no big deal if it's only a few minutes every now and again. Is it a violation? Yes. Is it something to lose sleep over? Not really.
It's just we have people coming here stating it's legal to run 50 miles over, or there is such a thing as safe haven in regards to HOS. There isn't. It just gets people that don't know better in trouble for following bad advice, which doesn't help TTR at all.
PC is already widely interpreted, and some people run into LEO's that interpret it differently. As Moose said, there are no LEO hiding in bushes at truck stops and/or shipper/receiver. Just don't have a pattern when pulled over for an inspection. Above all though, be polite to the LEO and what might have been a ticket might not even be a warning. -
What you want to do is avoid both. However stay in this business long enough and you are going to be forced to bust a clock. I think in my last years the clock I busted the most was the 14 hour clock. I did from time to time and noted it on my logs and got to a safe place to park ASAP. I know for myself when I was sitting in safety and they were looking at my logs most of the time the person would say I see that 14 and just moved on past it. However, I knew that they would place a verbal warning in the remarks. I once asked an FMCSA auditor about these things. He told me officially I have to say a violation is a violation and I have to act accordingly, un-officially I don't get too upset if I don't see a pattern. The FMCSA knows that shippers and receivers can be dicks. However don't ever make the mistake of forgetting they are REGULATORS charged with highway safety. Show a disregard of public safety either by a driver or a company and they will shut you down. EXAMPLE!
