No fault insurance claim compensation for down time?

    was recently hit in a truck stop by a company driver with 1 week expierence (driving alone) while i was sleeping doong a 10hr reset. Missed load delivery due to it after traveling over 600 miles with 100 left. Have been out of work 5 days in a hotel. I filed claim with my insurance and want to know how to go about recouping every expense due to this untimely incident. Advice welcom and appreciated! I am the company owner on my side.

    Yep, get a lawyer. Your insurance company wont offer much help beyond covering your equipment and the load, You need a lawyer to get the extras paid for.

    Even if your insurance pays you they will either drop you or jack your rate up, you will have a 'claim' on your insurance record this will effect your rate or ability to get insurance in the future. The insurance companies have perfected a system 'head they win, tail you lose'. Fill a claim on the other driver's insurance.

    Was it hit and run or did you get the other guys insurance?

    I had one guy back in to my mirror. Almost took out the side of truck. When he realized what he did. He took off.
    He was gone before I could get my shoes on.

    Why would the OP's insurance have to pay for this? It wasn't his fault. A company driver with with one weeks experience hit the OP. The company who owned the truck that hit the OP is the insurance that should be paying.

    Now to the OP, your insurance should be able to help you to some degree. But, as noted by other members, get an attorney & have him to get involved. I bet they'll pony right up. Just be sure you let them know your insurance might be in the mix of helping you to so her can get in the lop with them.

    Had same thing happen to me few years back. No personal injury so lawyers didn' want to get involved. (No provide for them thier). The other guys insurance company kept jerking me around. Finally after 3 weeks they offered me a choice. Take to thier shop, or they would cut me a ridiculously small not enough to repair damage settlement. No pay for time off rental truck or anything. I finally called my insurance company. Was told you should not have tried to handle on your own. My insurance company sent out adjuster, to look at damage. Then gave me a choice, take check for xx amount. Or put in shop have repairs done, plus rental truck cost reimbursed. They will pay and go after other imsurance company. Bottom line for me was, the insurance company only want to work business to business.

    It's common practice for insurance companies to pay for repairs to get their client up and going, then once fault is determined to be on the other party, they go after their insurance company for reimbursement.

    When I said get a lawyer, I didn't mean it would be cheap. For under a grand he should be able to get a lawyer to generate letters and requests for reimbursement on the terms of the insured, not the adjuster. Don't ever take a settlement when it is first offered by yours or the other parties insurance company. Once a lawyer is involved, 9 times out of 10 they will settle or work out a deal close to what you want because going to court will cost them much more than settling the claim out of court.
