Am I responsible for truck damage?

    Lost traction at a Port backing an empty trailer in the snow. Forklift operator came over and just started pushing. The fork broke the speed/cruise control sensor. Ryder says it is a $2000 sensor! I am a 1099 driver for a temp service and am not sure if they can make me pay for damages? I resigned and I never set up direct deposit although they hounded me to! I never asked or told the fork lift operator to push he just took it upon himself! Can they come after me for damages? Not sure if I signed papers stating I would but did file an incident report stating the above and saying it was not my fault.

    Don’t pay it. It’s not your truck. Bad judgment but your not responsible.

    They are not paying you legally, what makes you think they care about any other laws?

    Kiss you last paycheck goodbye and go get a job that's legal. You won't have to worry about stuff like this.

    Thanks but got my last paycheck as I had already resigned. Company who's truck I was driving when this occurred hired me on as a company driver. They were happy to have me!

    at a company in which i was the yardman/boss, (in fact, both Ryder and then Lily) from time to time, we had to have temp drivers.

    temp drivers were never charged with any damages to equipment or freight.

    however, we would never call the temp agency again, and request that particular driver.

    Speed sensor/cruise control is typically located on the top of the transmission tailshaft. It would be nearly 99.9% impossible for the forklift to break it, and its not a $2000 part. Even if it was a wheel speed sensor, its still nowhere near that much.

    He broke the radar up front which is tied into the cruise I suspect

    Ahh, that makes a lot more sense. So it will be awhile before that truck can slam its brakes on when it sees a shadow.

    It is the companies problem, just walk away.

    And a couple lessons ...


    Never take a 1099 job ... even it is a temp job .... if you do, make sure there is a contract

    And never ever let a fork lift driver touch a truck outside of loading/unloading it ...

    In this case the forklift driver and the place who employees him are really responsible for the damages.
