Leaving your lane and striking a vehicle is wrong. Parking on the side of the road, barring mechanical failure is also wrong. Either way, you're where you aren't supposed to be.

How about we assign blame equally 50/50?

Lawyers already called the 4-wheeler family I bet. Trucking company insurance will pay big.

I'm not saying his elog shut him down on the side of the road. I'm saying maybe his day went to crap and instead of doing what anybody on paper logs would do and just drive to the nearest safe spot and not ever think twice about it, he had to worry about how that's going to look if he has to drive 10 or 15 minutes over his hours today and gets in a wreck tomorrow. Once again I'm not saying parking on the shoulder was a good idea but I'm also not going to just assume he's just an idiot who always parks on the shoulder or he didn't properly plan his trip.

Parking on the shoulder of a freeway, on or off ramp is dumb.

And maybe he was too lazy to do his job and find a better place to park. And no I cannot understand the thought process that he had that he would think it was in any way shape or form it was ok to take his 10 on the side of the expressway.

Does crap happen? Of course. I have yet to know of any non-breakdown reason to be where he was other than pure laziness. He easily could have pulled off an exit or 5 before hand and found something. A strip mall is everywhere for example. He just wanted to get in every last minute of driving he could.

I can’t quite get there in my head on the 50/50 blame.
If the truck wasn’t there it would have been probably the guard rail they hit and killed somebody.
If that was the case I couldn’t in good faith assign 50 percent blame to the guard rail.
At the end of the day if the suv didn’t illegally leave the highway there wouldn’t have been any accident and we would not be having this discussion right now.

for the love of god, i cant understand why some of these guys cant grasp the concept. The only thing the truck did wrong was park illegallly. punishable buy a friggin 100 dollar fine. Trees, concrete bridge structures and guardraills arent subject to fines. niether is hiotchhikers, tow truck drivers and innocent oncoming traffic. the suv driver left the road for whatever reason and paid the ultimate price. Mechanical failure, eh i highly doubt it.

Contrary to popular belief, you don’t have to max out your hours every day. It’s ok to shut down early if you can’t make it to where you originally planned to.

Unfortunately the thinking today is not one of personal responsibility.
It’s always someone else’s fault but not me seems to be the mantra for most today.
The mentality of if the truck wasn’t there there wouldn’t have been an accident or death is just ludicrous.
