Parking On The Shoulder, 3 Dead

    Another personal rule of mine is never park next to a guardrail, jersey barrier, etc., regardless of emergency unless truck is immobile or barrier is way too long to drive past. Blown tire? Overheating engine? Drive on (slow) to a point where you are less hemmed in.

    Contributing factors, but the total responsibility for placing the truck in that position at that point in time is 100% on the driver.

    Drivers do have control; not the clock. It is up to drivers to use the tools at their disposal to complete their job within the framework of regulations and corporate policies. If a driver is continually running into time issues it is possible they are poor at planning or they are working for a company that has unrealistic expectations. If the latter, then they should likely look for employment elsewhere as those types of companies will typically throw a driver under the bus at the first issue.

    I know that I’m naturally drawn to vehicles parked on the shoulder.
    And I have to work not to drift towards them.
    So odds are that car wouldn’t have left it’s lane if the doofus wasn’t illegally parked on the shoulder because he was too lazy to find a safe place to park.
    .
    He should lose his CDL just for taking a 10 hour break along a highway.

    You are not the only one... ESPECIALLY when tired/fatigued. This has been the subject of various studies. A related issue which I commented on in another thread is that some law enforcement agencies have started to tone down or change the lights at the rear of their vehicles to reduce such collisions.

    That is one of the factors in why people crash; when the SHTF, they panic and look at the obstacle, ditch, barrier, etc. In racing you learn to do exactly what you posted; it takes discipline and practice. It's REALLY important when riding a motorcycle too.

    Yep, it's why they tell you to look at the fog line on a two lane at night as opposed to staring at the oncoming headlights.

    Let's focus on the problem and I will guarantee you that if we look at this truck driver's elog and exactly where he takes his breaks we will notice a pattern of parking in stupid places.
    Lets not defend this stupid thinking that we can park anywhere we want.

    This driver will be going to prison for a long time and he deserves it.
    I see drivers parked on the shoulder too close to the travel lanes all the time. Yes I know it is not easy to find parking right on the 11th hour. However that’s not an excuse to park on the shoulder just because you are too lazy to put some effort and find a safe place to park.
    Last year a driver parked in the travel lane on a 3 lanes street so he can get breakfast at McDonald’s. A car crushed into him and killed the driver. That guy was charged with negligent homicide or something similar.

    In prison for a long time? Haha how do you figure. He was illegally parked. For you to suggest vehicular manslaughter is pretty silly. The truck driver was not found to have been drinking or on drugs He will get no jail time at all. If the family of the suv has a good lawyer they could probably sue the company. Look at the rediculous Werner lawsuit.
