    If you are pulled in the the scales in Minnesota DO NOT TAKE THIS SURVEY!! If you get to many "check marks" they will put you Out Of Service no matter what your log book says. If you do take it they will take a look around in side your truck. Here is a link to the survey questions.

    You may NOT have a choice to say, "no thanks". The current talk is that the MN state Gestapo will soon be mandating the fatigue 'checklist' on a random basis(ie every 100 trucks).

    Apparently, The Peoples Republic of Minnesota sees a need for more bureaucratic enforcement in the transportation industry. :roll:

    From what I heard on the radio if you get three of those "violations" checked you get an out of service violation because you are driving fatigued. They were making fun of it and I can see why........


    Most of these seriously do not make any sense at all.


    If I am forced to take this "survey" I am going to be out out of service every time.

    I mean I have a cell phone (who dosent?)
    I have a laptop. (technically its a video game system also)
    I have a TV.
    I have a couple books so i have "reading material"
    Clothing in berth ( not sure what this means......... but what driver dosent have extra clothes?)
    And im sure you can find an empty soda can somewhere usually.

    The outside of my truck is usually dirty as well since werner only pays for 1 truck wash a month......... also some cons wont let you sweep out your trailer on there property so the inside could be dirty as well.

    So basically any time I go to MN they can put me out of service whenever they want.

    I guess they are trying to see what you're up to if you arent sleeping.What a dirty vehicle has to do with anything is beyond me,I was in sleeper & couldnt wash truck.

    Use of Prescription Meds Asking about the use of prescription meds is vary inappropriate and a clear violation[FONT=Verdana, Arial, Helvetica, sans-serif] of the [/FONT]Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule. Grow some hangie down things and just say NO THANKS I dont have time to take your survey.

    I agree, it is total B.S.

    However, if one chooses to refuse 'Barney Fife' in taking his little Nazi 'survey' they will just pull you over for a level 3 and put you out of service anyway. (regardless of the 'size' of your 'hangie down things').. :biggrin_2551:

    HIPAA rules do not apply to law enforcement. These laws are aimed at the medical care profession and institutions dealing with the medical records of the patient.

    As far as using prescription drugs, your long form medical form is to contain all of the drugs the driver is taking. Access to the long form is part of the dot inspection. It is also required for a CDL driver.

    You will get nowhere trying to argue this under HIPAA.
