HOS Confusion with local work?

    What matters is what YOU do with the load and the BOL should reflect that. Any other way is illegal. All those rule on interstate commerce are meant for somebody else not the trucking company. IE tarriffs and taxes.
    What the BOL reflects is all that matters and is true to what YOU did.
    You do carry blank bols dont you.

    Let's allow our two motor carrier enforcement officers weigh in on this, afterall they are the folks that enforce the rules.

    You see, here is part the part of the interstate commerce definition you can't seem to grasp, the fact that your cargo will leave the United States when it is loaded on a Russian rocket and shipped to orbit. Again, it does not matter that your part is only in CA, the entire trip is what determines if the state or the Federal Agency has authority.

    3) Between two places in a state as part of trade, traffic, or transportation originating or terminating outside the state or the United States.

    The regulations apply not only to you in your occupation, not trade as used in this definition, as a truck driver but also to your employer as a motor carrier.

    So, part 390.5 of the Federal Motor Carrier Safety Regulations are not meant for motor carriers? Interesting logic, wrong but none the less interesting.

    Thats your opinion not mine. If you are crossing state lines then yes but a load originating in China that is picked up at the dock and you deliver it within state that is intrastating and the bill of lading should reflect what you or motor carrier did not what the load did.
    Eg you stop at the scale and you hand the inspector a hand full of papers that states China to SF the inspector could ask for your authority to import and log for the time involved. Again the BOL or POD if you prefer should reflect what YOU actually did and why would you give the DOT reason to doubt you. I swear some of you go looking for trouble.
    Where the load originated and ultimate delivery doesnt matter. its what you actually did that matters

    If your trade, traffic, or transportation is one of the following, this is considered interstate commerce.....

    Nowhere in the definitions of interstate or intrastate does it mention cargo. It mentions "You" and "Your".

    If they meant your cargo, they would have said "If your cargo meets one or more of the following...."

    COBB2070...it's very obvious that you have your mind made up and that no amount of argument is going to change your interpretation of the rules.

    Some of the other members have tried to help you but you'd rather have validation of your own ideas, whether or not they're factually correct.

    Beyond a certain point trying to give advice to a person who really doesn't want it and, in fact, argues with it is a waste of time.
