Is being loaded overweight a breach in contract?

    i believe we have been loaded 10,000 lbs more than the agreed weight in the contract. We were stopped at a weigh station and got a fine for overweight axles. Is this something I can get rectified/paid for by the broker since the contract was broken when we were overweighted?

    I thought that loading 10 to 20 thousand pounds more than the agreed-upon amount was standard practice. They promised you a light load and get you to agree to haul it then they load twice the amount of freight on once you show up hoping to get it for the same price.
    Typical bait and switch.

    I hear you. The agreed upon weight was 48000 though. We were less than 400 lbs from being grossly overweight!

    I have never heard of it being called a breech of contract. I have always either took a chance and taken it or made them get it legal before I left, depending on the situation.

    Turn the load down and tell them to unload your truck or you won't move until it's all off or you will now pay x amount if you wish me to haul it

    The thing is, we didn’t know it was overweight when we left. We found our when we were hours down the road. We looked into portable axle scaled we could take with us... but those cost $2,000!

    The weight they gave us was 45000... but getting to the weigh station, It didn’t add up when we subtracted what our truck and trailer weighed.

    And your cat scale ticket didn't say overweight?
    Cause if you don't have one it's on you for not scaling.

    Always cat the load. That 11 dollars is a small expense to discover your true weight minus a previously weight that is empty, full tanks and driver in that truck.

    Do you have a spring ride truck and trailer? When I ran the 48, I didn't have scales and rarely used a cat scales, but could tell within a thousand pounds with the squeze gauges and would hit the cat scales if close.
