    Well 78 minutes into my 10 hour break, I put myself into sleeper berth.

    I had to do this using the e log device. An essential piece of equipment mounted inside the CMV.

    How can this task not be catagorized as on duty not driving?

    WHY? That's the real ? here. And in case somebody missed it you better spend 8 hours continuous there or you're not legal to drive. No i'm not referring to split for teams.

    For the OLD guys and gals the rule was ''no distinction between sleeper and off duty'' and somewhere the DOT decided OH we like to see 8 hours sleeper on there own volition. And now we have mass confusion.

    The DOT has free reign on what rules they want to enforce ,right or wrong, and can interpret them any way they want.
    Remember the DOT officer gets paid no matter what he does and on court days sometimes 8 hour pay for an hour in court on overtime, right or wrong.

    What's that phrase ''absolute immunity'' or something.

    Fmcsa 395. Everyone of the regs there (except the split sleeper berth) state either 10 hours off dity or any combo of 10 hours sb and off. Here is one example from 395.2.
    (1) At least 10 consecutive hours off duty;

    (2) At least 10 consecutive hours of sleeper-berth time;

    (3) A combination of consecutive sleeper-berth and off-duty time amounting to at least 10 hours; or

    Since you are so insistent on this why not show the regs where it's stated. Not old, outdated guidance, but the actual regs.

    Dave, just so you can get the absolutely necessary and required rest of 10 uninterrupted hours, I offer this solution:

    After driving, put yourself off duty on the ELD. Remember each time you move into and out of the sleeper.

    At the end of the 10 hours, sign into the ELD and make the changes to your duty record.

    See, easy, peasy and all legal, and you'll finally be truly rested....
