there is no difference in legality if he did as you say. That would involve a case of logbook falsification. As such, that is NOT legal no matter which way you want to log it.

If he took drove into the receiver 10 hours sooner then his logbook shows and took a break, then he is in violation on his logbook. If he didnt take a break at the receiver, then he is in violation of the 14 hour rule.

The only way something is legal in your logbook is if you log it as you drove/worked it. Now as he said he did log it, there is no way to log 1000 miles in 18 hours legally from start to end as a single driver as he claimed. Even if he did log it as he drove it, he is still in violation of the HOS. so any claim of being legal is not true. he broke a few laws in there assuming he has given the complete story

    3318 on the odometer
    ~3250 paid
    One 'shift encroachment'

Usually the miles would be a little lower and the encroachments would be 2or 3. Was a good week and was mostly drop/hook at 24 hour locations.

RickG, I failed to mention I am a super trucker, so that should put some minds at ease. If I am tired, there is a 63" sleeper in the back, and I am not irresponsible in my actions. I will never agree that the HOS dictate or mandate when I am tired or how much sleep I need. If my hours run out and I am an hour or two from the house, I am not taking a ten hour break in a truck when I can sleep in my own bed.

    Flyer Thanks this.

Not to hijack the thread, but some people here know I am a deputy. I work nights, so I go to bed at 8 am and get up around 3 pm or 4 pm. So, I get up at 4 pm, stay up til the next day, have court at 9 am which sometimes lasts til 1 pm or later. So I have essentially been up the same amount of time as if I had got up at 4 pm, loaded cattle and driven, delivered and got back at 1 pm the next day which is what I do in my off-days. I do not believe in enforcing the law to the letter of the law. If I did, I would go through at least a ticket book a day and make countless arrests each day. That's just how I see it.
