Pre-hearing for Failed Drug Test and Employment

    Hello all, I'm new to this Forum and had a few questions from anyone with experience. Here is my hold up.. I just graduated from CDL-A Trucking School and was seeking employment. The first job I applied to I did a pre-employment drug test and failed. It was for a prescription drug I was taking and never got a call from the MRO (Medical Review Officer). I continued my search for another job not knowing I failed because I never received a phone call asking about my prescription.

    Long story short i'm here with a brand new CDL-A License and have a pre-hearing from the DMV next month.. I graduated almost 2 months ago and this will put me at about 4 months of being out of school with no Trucking work history.. I was told by another recruiter i will probably have to go back to trucking school.

    So the question is will a job hiring me know that i have a pending Pre-hearing and will they still employ me?

    No, you won't have to go back to school.
    Some companies that hire you will put you through a refresher course with a trainer.
    How does the DMV know you failed a pre-employment drug test?

    I guess I meant the DoT. Do you know if any employer would know that I have a pre-hearing? My license is still active and not suspended. the only problem is when I call companies or recruiters and tell them that that is on my records they automatically tell me I have to wait until it's over.

    I don't know. Never heard of a pre-hearing.
    You'll probably have to complete a SAP (Substance Abuse Program), unless the pre-hearing determines otherwise.

    Adderall. and I know it's not a problem because I went through truck driving school and drove a truck with a permit. the only problem is that the medical review officer never got in contact with me and just saw that I failed a drug test and reported it to the department of transportation

    Your state is not going to do anything to your license unless your drug is illegal. Pot would be one that's schedule one at the federal level. Banned from any use medically in any form containing THC.

    Drug tests are a way that the industry keeps the riff raff out. If you have a legitimate medicine that was prescribed to you for a specific time frame, get the letter from your prescribing doctor and take that to the hearing with you.

    I would hope not because I do not have any illegal drugs in my urinalysis it is a prescription drug prescribed to me and when I went through school it was never a problem

    yes sir that is the plan but my question if you know the answer to it is if I apply to a job well they see that I have a pre hearing scheduled and will that bar me from employment

    The predicament that I am in is that I have no experience after trucking school and by the time it's all said and done I will be out of trucking school for about 4 months with no job
