Little help from the owner ops out there.....Landstar?? 1099??

    OK....I'll make this short and sweet.....I had a spotless record until a couple weeks ago, 2+ years perfect. Now I am ahving a hard time finding a job because the last employer said I damaged a trailer....actually they said I failed to report an accident. There was no accident and I have a lawyer working on this for me.....in the meantime, while every place I try to hire on with tells me they won't take me with that on my record, I found a guy with a truck. He will hold it for me for a while, he's working on it anyway, but he said I'll drive his truck, 2004 379, and be leased on to Landstar. He wants me to have a computer and handle everything myself. I lost my home to hurricane Ike this past fall so don't really need hometime. Hometime is wherever I am parked :biggrin_2552: I can stay out as long as I want, my wife rides with me so I could run hard for as long as I need to in order to make enough money to put down on a home again.

    My question is......the guy says he'll give me 29% and something about a 1099. I've heard KR say how we should avoid guys who use the 1099, so can anyone give me the pros and cons of this job? Is 29% good or am I being taken for a ride? Keep in mind, until the lawyer can straighten out my DAC, IF he can straihjten out my DAC, jobs are near impossible to come by. Thanks in advance.

    I would say you are in a "special circumstance" here. Pro's of 1099 you are subcontractor and get 100% of your pay every week ( no taxes taken out), con's if you get hurt, sick, laid off, etc... you have nothing to fall back on such as unemployment, workers comp, etc.... If you go this route make sure you keep EVERY RECEIPT FOR ANYTHING you buy, as most may be tax deductible for you at the end of the year. Also ould be a good idea to set money back especially for taxes that you may or may not have to pay being a 1099 subcontractor.

    In your situation you may want to consider this since you got screwed by the company you worked for and may have trouble finding a job for a while. The 29% i guess depends on 29% of what. The total the load pays? In that case may not be bad since you will be choosing and arranging your own loads, you will know what you will make up front. Don't need hometime, well sounds like a nobrainer to me since you are not working now at least till you could try and get this other issue solved. Good Luck

    Kind of the way I see it, atleast it gets me back in a truck.

    and he said it would pay 29% of what the load pays....anyone else??

    You are an employee and he is just avoiding the proper treatment as such.

    Personally, I would not work for such an operation.

    You run the risk of falling or getting hurt. You would be out of luck since no workmens comp would be in the corner.

    I doesn't sound bad. If you are booking your own loads you will know what you are making. Like the other poster said keep track of all of your receipts. Also put money aside every week for your taxes. That way you won't be screwed at the end of the year. Good luck to you in what ever you decide to do.

    You need to make sure you save enough money to pay your own taxes. Seem to me it is a good oportunity for you. Do you know the owner of the truck? If you do and trust him I say go for it.

    I Hired a guy to drive my truck at landstar. I payed him 25% of the whole load, line haul( after there 27% cut) and Fuel Surcharge. But I payed him as a regular employee. Had a payroll company do his pay. Its not that hard to pay you as an employee (W-2), just more paperwork.

    I forgot to ask. Is it 29% plus FSC or just 29%? Is the fuel cost coming out of his cut or yours? Also who is responsible for the repairs and maintanence on the truck?

    AWESOME question!! :biggrin_2551::biggrin_2551: Never crossed my mind about the fuel, I just assume it comes out of his end but I guess I don't know for sure. That would make a H U G E difference. Guess I'll get more details from him on Monday. Any other questions I need to ask before I go ahead? I also need to get accepted by Landstar before I can do this. If they are understanding I can go ahead Monday. If they are really picky I may wait, my lawyer seems to think he can straighten out the DAC issue pretty quickly.
