Was She Right or Naw?

    Hello truckers out there! I am currently in school for my CDL. I was on CDLLife checking out posts when I noticed a post of a trucker video blogging her experiences. I want to get any information I can that is out there so I clicked on over. However after getting there I found her to be a moron. Now before you jump on me please go listen to what she said. I could care less about how she felt about how she was treated and how bad CFI sucks, she's allowed to voice her opinion (Snowflakes do that a a lot you know complain about entitlement.). I had a problem with her thinking that the fine for not having a inspection sticker was the company's fault.

    FMCSA Regulations Part 396 Section § 396.17: Periodic inspection.
    Question 4: Does the sticker have to be located in a specific location on the vehicle?
    Guidance: No. The rule does not specify where the sticker, decal or other form of documentation must be located. It is the responsibility of the driver to produce the documentation when requested. Therefore, the driver must know the location of the sticker and ensure that all information on it is legible and current. The driver must also be able to produce the inspection report if that form of documentation is used.


    As I read this she should have verified the location of the sticker prior to accepting the Truck. ie DVIR. Am I wrong and if I am why?

    Actually yes, and make sure the hard copy is there as well as the registration, cuz you will be the one ticketed. Now, if there was not one, the company should not have sent it out either.

    It's the same as having an expired permit. While the company should know this and ensure you receive a up to date permit, I should know when and if a permit will expire so I can avoid the fine and have correct and required documentation.

    For every sticker and tag on that truck you need a corresponding VALID ie NON EXPIRED card, permit, etc. for that. And the vehicle must have a registration, and any trailer you put on must also carry it's own registration in the bubble near the gladhands. All of that must be valid.

    IF it aint, your office permit drone will hand you valid ones.

    If any of the cards are not present or expired or you do not have the stickers etc then it is YOU that gets the fine, and pays the same.

    DVIR, do not move that thing a inch until she is legal all over.

    A month after I started I got my first inspection, a level 3, and it turned out my incab registration card was expired. Violation went to the company, no fine to driver.

    I got pulled over for speeding in NV several years ago. Passed a hwy patrol on a two lane on a curve going the opposite direction. I knew I was going a little fast. Saw his lights pop on just as he disappeared around the bend. I was the ONLY vehicle on the road. He was coming for me. I pulled over at the next safe spot and waited. He comes pulling up behind me and walked up to my truck and says " You knew I was coming for you, didn't you?"
    "Yes Sir"
    "So you know you were speeding then?"
    "Yes Sir"
    "How fast were you going?"
    "Fast enough that I pulled over and waited"

    Which got a laugh out of him. He collected all my paperwork, permit book, log book (paper at the time) and went back to his car. He comes back about 20 minutes later and asks me to show him the annual inspection sticker on the truck. So, for the next 20 minutes or so, I looked all over that truck and couldnt find one.

    I walked away with a clean DRIVER inspection and no ticket, but the company got a written warning for the annual.

    Now I ALWAYS check paperwork in every single different truck I drive just the same as if it's mechanical. I look for cab cards, insurance, inspections, registration, permits. I also check for trailer registration and inspections. On the trailer itself in the box or bubble and in the permit book, depending on how the company handles their trailers.

    Did your company admit that it was their fault? I can truly understand the fact that it should be there fault but from what I've learned it is on me to check prior to and periodically when I'm out that nothing has expired.
