Yikes! I don't know much about leases, but surely there's some consequences in the agreement for them leaving you high and dry like that?
-
I still think driving off with the #### thing until "you can get back to NC" would be a good idea. Get a little money in the pipeline and get that check to include YOUR money that is being held hostage BEFORE getting eclipse's trailer.
You do 5 things for yourself:
1.) You help yourself to two weeks of pay without the 10% being taken out.
2.) You get your already earned money to you before having to search for a new trailer, while still being productive.
3.) You give Earl some warning that you will need a trailer/ give yourself more time to look for another source.
4.) You know that there is no guessing about how you will find freight and what it will pay. If you get another trailer the weights and measurements may change.
5.)You are able to ensure that you actually have the money to pay for any additional lease payments that you may owe at this point already- and any surprise payments (not that you will pay anyways but you know).
What can they say? Get the thing here by Monday or we'll kill you? I'll pay them a visit. Now where is my airline ticket? lol -
Hopefully you're kidding...The five items would make sense but a person might have criminal or civil issues to deal with.

Maybe. Doesn't stop him from finding a load running that way and getting paid for that at least. I wouldn't dead head it anywhere unless I absolutely could not find anything to put on it.
As for being late, well, the air line off the compressor blew. Can't help it. -
Well, I might agree with finding a load if it's on the way to take the trailer back. After that if would get tricky legal wise. I would rather give the trailer up than be sued or possibly put in jail.
Going to have an excuse for being late, better be able to show them it actually happened. If a bank would happen to own it now I wouldn't want to mess with them. -
I'm assuming a whole lot at this point though. If they know that you were in town and skipped out just to take loads for 2 weeks, yea you pretty much are gonna get slammed. If you are in California and a need to take a few loads in order to get to NC, you stay in contact with them and I would think that as long as they don't FEEL like you are holding out on them, they will wait a bit.
If the answer is "deadhead over here right now or we'll call the cops." Well guess what...hopefully they have a load going into NC. If not, your deadheading. I just don't see how they could do that, though. If I hand the keys of my truck to someone, I cannot charge them with Grand Theft Auto for not bringing it back the day I ask for it. -
EDIT: Or CAN I?
-
I pretty much agree with most of that. I did lease a trailer to an individual once and he was two to three weeks late bringing it back. I was able to sue him because of his delay and the fact he never would return my calls. It turned out he wrecked my trailer and was having it fixed. I had no idea it was wrecked.
