What to do when you only have one choice...and its illegal

    You need to fight this. Regardless. A lane violation ticket is a major violation. You get another one and you'll lose your CDL for a while.

    Agreed and I'm going to fight it...but its not a major violation. Its only 4 points in my home state (TN) and only 2 points in NC where it happened...following too close is a major violation (8 points in TN)

    I would fight it, but the problem will be that the officer did not see the other truck and 2 if you don't have truck co, truck # and trl # and no witnesses it will be hard to beat. Good chance the cop won't show up tho. Good luck!

    One thing I havent mentioned on here yet...the cop didn't have me sign the ticket.

    He had the X's at the bottom where I was supposed to sign, but he didn't ask me to sign it...he just handed it to me and said "have a nice day".

    I've had to sign every ticket I have ever gotten...I wonder if this is a possible "out" for this.

    He saw the other truck...but it was beside me in the right lane when he saw it. (not much help)

    If it's like Indiana it doesn't matter if you sign it or not. I refuse to sign any ticket just because I figure if I'm not guilty or gonna fight it I don;'t need to. Your only chance may be if the officer doesn't show up to court and you do it will be dismissed. They take that left lane law very seriously in the gorge and I doubt you'll beat it if the officer shows up.

    The offenses which constitute serious traffic violations are listed below. It is important to recognize that, unless specifically provided otherwise, a conviction for any of these offenses in a commercial vehicle OR a non-commercial vehicle will suspend or revoke your commercial drivers license.

    *Speeding 15 or more miles per hour above the posted speed limit;
    Reckless driving;

    *Following another vehicle too closely;

    *Improper or erratic lane change, including failure to signal a lane change; A violation, arising in connection with a fatal crash, of state law or a local ordinance, relating to motor vehicle traffic control, excluding parking, weight, length, height, and vehicle defect violations, and excluding homicide by vehicle as defined in Code Section 40-6-393;

    *A railroad grade crossing violation in a noncommercial motor vehicle;
    Driving a commercial motor vehicle without obtaining a commercial driver’s license;

    *Driving a commercial motor vehicle without a commercial driver’s license in the driver's immediate possession, and excluding such violations when the person's commercial driver's license or commercial driving privilege is suspended, revoked, canceled, or disqualified; or

    *Driving a commercial motor vehicle without a commercial driver’s license of the proper class and endorsements for the specific vehicle being operated or for the passengers or type of cargo transported.

    All disqualifications for serious traffic violations shall become effective upon the date that the Department of Driver Services processes the citation or conviction, provided that no such disqualification is in effect; if such disqualification is in effect the subsequent disqualification shall not take effect until the current disqualification expires.

    Nobody saw the lane change to say whether it was erratic or not...the ticket is for being in the left lane, not the lane change itself.

    I beat it...but I have to take a defensive driving course (online I hope).

    No points on my license though...thats what I was after.

    Great! ALWAYS go to court!
    I just hope your online course is better than the one I took for CA back in 2003! No spell check! Improper grammar and punctuation. The thing that really pee me off was there must be a ton of people who can't read over the 2 grade level! I'd read a chapter and go to do the test and the stupid thing would tell me I could not have read it in the time I did! I'm a writer and I read 2-3 books a week ! That course made me crazy to say the least! But I maxed it out!

    Now the REAL thing is what will happen even without any points when CSA2010 goes into effect! At least we can check it at any time without having to pay unlike DAC which only gives you a once a year freebie! BUT it looks like DAC/USIS/Hireright or whatever their name is this month might be going out of business! HOORAY!

    Graduate from school tomorrow. But I was just wondering, in school they went over various emergency braking and maneuvering. They Stressed that it was almost always safer to go to you right, onto the shoulder, in case there was a car in your blind spot.

    Would that have been an option, if the officer saw you breaking and moving to the shoulder, maybe the other guy would of been busted for the reckless way he was driving.
