Overweight Ticket

    I got a ticket from CHP for driving on a road that was commercial, but nothing over 6 tons. I was wondering if anyone knew a company like for example, ( ticket clinic ) or something of that nature that could reduce the amount. It’s over $500. I have to pay it by the 27th of this month (Merry Christmas to me right?!?) Lol!!

    The road means nothing over 6 ton. If you put a 40 ton 18 wheeler onto it, then you will have to pay the fine.

    It is easier to understand you cannot use this road over 6 ton and find a alternative route. But since you did not describe your immediate situation that caused you to take the 6 ton road (Where was this?) and why etc I cannot think to consider the local issues there.

    If you find a lawyer, chances are you might be able to pay a lesser fine on some other charge. Otherwise you come up with the 500 dollars. Be very careful here. If for whatever reason that is not paid by the 27th consider the possibility that a warrant will be issued for you. To attach you until this is taken care of.

    It was in Yorba Linda, California. I was going to a jobsite and I’m not familiar with that area, so I just followed the GPS. I didn’t see the sign about nothing over 6 tons until after the CHP mentioned it to me.

    Ok did your dispatcher or customer tell you to go that way? I hope they did.

    The first thing in trucking with due respect to the GPS is to go back and get a Rand McNally Motor Carriers Atlas and a pen and paper to write down exactly where you can go in order to go to point B wherever it is. The GPS is nice but will get you into trouble as you found out just now. The old school way of checking your route and asking questions to your boss, how did the other trucks go to here from A before? And they will tell you.

    In that motor carriers atlas is resources in every state you can contact and double check your trip routing planning etc.

    The one good thing about GPS is if you have the physical address of where you are going exactly, it will put a dot directly on that address. You can then double check with Google earth to see what kind of a place you are going to get into there.

    Every time you go to a new shipper or receiver, you want to look them up in Google maps. There may be some reviews telling you which roads to take. This is even more important in or near big cities. The other option is to call the shipper/receiver. Sometimes they have directions recorded on their lines. If not, you can speak to someone there so you can get directions. The road atlas can come in handy, but sometimes won’t be sufficient as it doesn’t always list all the streets. Another option is to use Google satellite. Usually the wider streets are good for trucking. Finally, keep an eye for weight limit signs or any other truck restrictions.

    Overweight tickets are not generally considered moving violations. Depending, you can get some moving violations dropped or downgraded to non-moving ones. I have a serious doubt you will get this removed or reduced. If the court will allow for it, I suggest asking the court to set up a payment plan. If they won't see if your carrier will help you and deduct it from your pay.

    One more point. I am ignorant of the California intrastate laws. According to the FMCSA (except in the case of Haz-mat and a Bus) the very definition of a CMV starts at 9 tons rated weight! Remember NEVER assume what that word Commercial means!

    Road/law will help you , call them mon, before everyone leaves for x/mas and they can call and try to get it put off till after new/years?

    If that road is the ONLY way in to the job site you should be fine. Take it to the Judge. Happens all the time here. Construction projects start and all of a sudden “no trucks” signs of some kind go up on all the roads. County Judge is cool here and throws out the fines.
