Can a Freight Broker Retaliate against a carrier for a valid claim on their bond

    Retaliate? How? Carrier 411, trying to slander your name? They cannot just not pay, that's what the bond is for.

    That presumes that the claim is indeed valid. We only have the OP's word that he *believes* it's valid. We don't have enough actual context to unpack anything that's going on.

    I get that it's fun to #### on brokers, but just don't know enough to have an informed opinion on what's happening, you know?

    I don't think it's fun. Just the opposite. It's maddening when people can't do their jobs, and wastes A LOT of valuable time.

    I don't know about the op but I am talking about legitimate claims. I never filed one or think it should be done frivolously or for some small, insignificant amounts like half hour detention. Nor should be the retaliation methods, such as smearing someone's name on some reviews, especially where you don't have a chance to respond or even read what they say about you.
    Anyways, I consider not paying someone in the business as bad as murder(almost), so they had better good reason not to.

    No disagreement. I find that true in all walks of life.

    Fair enough, man. I'm just speculating that their could be a legitimate reason or reasons as to the why of it. Folks don't generally no-pay for no real reason.

    Incidentally, I do tend to agree with you on non-payment, though. I spend a not insignificant amount of time as an impromptu collections agent each month, so it irritates me to no end.

    There was a load I just did, or actually didn't do, that I got shoved up my ###.

    And I just knew it was coming. The guys demeanor, certain phrases he used, the 27 emails, phone calls, and texts leading up to the load.

    And it cancelled the morning it was supposed to pick up, with me in the lot.

    " Wait, I have other clients there."

    No, how about you go expeditiously F yourself.

    It was a fishing trip.

    Got my TONU. I'll never call him again. If myself or one of my trucks are his saving grace someday, it will be the most expensive van freight in the history of the world.

    Most of the time, the non payment is triggered by some mess done to the product resulting in too much damage on the BOL, or complete load rejection. A broker like TQL, but also Schneider or any other will hold all the payments due until the claim is resolved and that could be awhile. It does not necessarily mean that carrier was at faul . But it could be too long to wait for many. I see it being a huge problem, if a carrier gets a larger share of his revenue from that one brokerage. A claim should be filed in that case If there is no clear evidence that the carrier was at fault.

    Hi guys. Have an issue with a freight broker. He didn't pay for my job I've done for him.
    I clamed bond from his surety bond provider and got this answer:

    """Hudson Insurance Company (“Hudson”) issued Bond No. 10060865 to Safe Express Solutions, LLC to validate its FMCSA-BMC 84 License. Said bond covers, among other transports, shipments within two locations in one state only when that shipment also happens to pass through another state, thus affecting interstate commerce. Your claim documents indicate that you carried a load within the state of Texas and that the load did not pass through another state. Therefore, Hudson must respectfully deny your claim."""

    Does that mean ,I'm absolutely defenseless against cheating me by dishonest broker?
    Please, push me in a right direction if any.
