The "Upon a roadway with unobstructed pavement of sufficient width for two or more lines of vehicles moving lawfully in the direction being traveled by the overtaking vehicle" part is the critical part.
Passing on the right with only one lane is what is illegal. E.G. using the shoulder of an undivided highway. Passing on the right on an interstate is not illegal.
Basically it is illegal to pass on the right if you have to use the shoulder.

Seems to me passing on the right is perfectly fine basically as long as you keep it on the pavement. Now, that said, what kind of a colossal idiot makes a habit of going off the road to pass slower traffic? -
as a general rule i'd stay in the middle lane to avoid the morons coming onto the highways from an on ramp.
but if it was busy, i'd stay to the right, then move over when i could.

When your driving down the interstate and your about to come up on someone going slow and you get over to pass and then they get over for no reason this is what im talking about. Driving in the middle or left lane for no reason at all.

I have no problem with anybody in the middle lanes as long as its in a city but when your driving through no mans land and a on ramp comes up there is no reason than to go to the middle lane. People that merge have to yeild to you anyways.
