Ya well my grandmothers aunts sister told my friend johnnys sons 15th cousin that the DOT pulled that truck over and gave them a ticket.
Do the OEM’s make mistakes? You bet they do but there is no way the mistake like your example are standard.

I'm going to go out on a limb here and say this.

IF there was a law. It probably would have been written BEFORE jakes ever existed.

And, it time to update this supposed law.

The law also states that brakes and tails must be red. And yet, yellow is the new thing.

I know one sewer truck driving around with FLASHING yellows for brake lights.

They'll just start making 3-stage taillights that can flash too.

Here's something interesting that they were toying around with in ‘68 when they were doing studies for the new 121 brake system standard C1E6C8C9-3348-4834-9DB2-15B57FCDFDF0.png

Also read in that site that in 2001 someone had applied for a patent on a device that would allow the tailights to change brightness levels with decel rates.
In otherwords get brighter the harder you brake. It would also allow the lights to brighten slightly with any decel event without service brake application.
It did however state that the patent was not issued.

Not tying to contradict anyone. Just found it interesting. Also goes to show that the engineers in the automotive world don’t sleep and keep trying to reinvent what is perfectly fine already.
Just imagine the confusion of that light system mixed in with all the other light clutter around the roads. Hard to tell now with Amber turns on the tails sometimes whether something is coming at you or away from you.

Guys here in town make this for motorcycles. It has a modulating brake light and an accelerometer that can be set from off to various levels of sensitivity to turn the brake lights on when decelerating without using the brakes.

As far as I know and I may be wrong but I think KW auto sets the brake lights to come on with the engie brakes because of califonia. I think California passed some regulations requiring their trucks to turn on brake lights when either the brakes or engine brakes are being used.
