So I just got an email from HireRight saying that they finished my dispute "investigation" (2 days before the deadline of 30 days)
When I called their service line to inquire as to the actual contents of the "investigation" I was met with the response that my former employer (Werner) has "reaffirmed" their assertions over what I was disputing, and that aside from a rebuttal, there was more or less #### all I can do about it.
I am going to contact their "dispute team" and inquire as to what evidence Werner has provided that corroborates their allegations against me, but beyond that I don't know what else I can do, or if there is a legal recourse that I can take against Werner and/or HireRight for pushing this attempt and virtually blacklisting me in this industry. I myself have already provided several detailed statements with an account of events and photographic evidence with a detailed breakdown of the contents of the photographs.
It floors me that my CDL and my livelihood is being dicked with based on what a couple of "safety department" desk jockeys have for hearsay vs my first hand account of events, you would think that my account might be weighed more heavily than the hearsay, no?
I'm at a loss, what do I do?

They have to let you put a statement from you in your file, explaining what happened. Then when a company orders your report , your statement will be sent as part of it. Maybe not much but something, anyway
InTooDeep, Dave_in_AZ, x1Heavy and 3 others Thank this. -
I'm thinking Class Action Lawsuit time, more maybe just go postal at Werner HQ in Omaha, whatever is more entertaining. -
Right. Let us know how that works out.

What can actually be done? -
You can do what I suggested and put your statement in.
Hireright has enough lawyers at there beck and call that threatening to sue. It isn't going to ruffle their feathers any. They are part of General Information Services.
What you can do is to start applying at smaller companies, many of which don't use Hireright. Check craigslist ads. Keep calling and applying and someone will give you a shot.InTooDeep, Western flyer, x1Heavy and 2 others Thank this. -
Western flyer and Badmon Thank this.
