    You can't just show up and evict someone, it's illegal. The notice time varies but it's like 60-90 days and you have to have the sheriff do the evictions. What kind of idiot state is Florida? (dumb question)

    In some states, once you own a new property, it's yours. In Pa if you purchase a house without a lease, you own it all, and may remove anyone or thing from the property. Mark

    That applies only to rentals or leases. The home was sold and therefore there are no eviction rights. The only way any sort of eviction rights would be involved is if the home in question was a rental income property that does not have the actual owner living on the premises.

    At this point, the owner could try an eviction but the renters do have rights and could block the eviction by court order especially if a signed contract lease is involved. Very few rental owners build a clause into the contract stating the lease is void upon the sale of the property. Some do though.

    Florida resident, renter. Signed a 2 yr lease for house. Payments paid on time by cashiers check to property mgmt group. After over 1.5 yrs, on New Year's Eve of 2008, foreclosure papers served at residence. Seems "landlord" got the rent payments but elected to quit paying the mortgage. Had to get a lawyer to file documents that we would no longer be paying rent, could've stayed at least to end of lease but came to really despise that house and moved. New legislation passed here but too late for us.

    From what I understand, this was all due to a mistake that apparently no one has apologized to the homeowner for making.

    Oh man, I would be pissed. I have to give the bank credit since they at least showed up with her though. I would make them pay for moving my stuff back in though...and get some really good concessions on my loan while I was at it instead of suing...be better for all!
