Except for the part where the people who do have access to the full tape decided he was at fault and punished him for it.

it is very likely that there was no audio, ny employs primitive dash cams, and the sheriff was likely trying to save face in the light of the media scrutiny, so a 30 day paid suspension was like a vacation for the officer.

If he really did something wrong he would have been fired.

I have been pulled over for speeding. But, I've never been yanked out of a car. Maybe it's because I'm WASP. Or maybe it's because I measure my words and behavior. Regardless, the cop has the upper hand. If you escalate it, he wins.

He deals with the worst of the worst everytime he approaches anyone. He doesn't know who you are or how you will behave. He always expects the worst.

I am not sympathizing with the cops, I'm empathizing with them. They aren't always right. But on the initial contact they get the benefit of the doubt. At least until he says, "you are free to go".

So, is it custodial? It could easily become custodial. As long as I have some control over the situation I will do whatever I can to prevent it from becoming custodial.

how was the cop wrong??? he simply went back to see her record to decide whether to give her a ticket or not. before he got half way she was outta the car demanding he show her the tape. sure he can show her the radar gun and such but go fight it in court woman not on the street.

If she had just stayed in the car she never would have been tazed or arrested period!

I wouldn't get voluntarily tased for anything. I like the whole not being crippled or dead thing. TASER has quite a few officers suing them for injuries received during those sessions, at least one police chief.

that video DOES make it look like the cop was wrong. but without the audio we can't be sure. however, why did she get out of the van? stepping out of a vehicle for a traffic stop that simple is something you shouldn't do.

If you want to argue the validity of a ticket do it in court. not the side of the road where EITHER party could be hit by a passing vehicle. There's a reason tickets have a way to request a hearing in Court.

Taser is being sued for subjects VOLUNTARILY being tased? and as far as i know most departments have dropped the being tased as a requirement to get a taser.

Yeah, because TASER assured them that it was perfectly safe. When they end up half paralyzed, permanently, over a training session, people tend to get pissed off. That's why the departments are dropping the requirement. It's still ok to zap the hell out of the general public though.

I am a cop hater, I think they are overbearing and ########. But in this instance, the woman was at fault.

#1 I bet if there was sound she was being belligrent, I doubt she was going "show me the video please." No I bet you it was something more like "I am not dong anything till you show me the video"

#2 When a cop asks you to do something you do it. End of story. He asked her several times to get back in the car, she admitted it. How many times have we seen this go the other way, person doesn't obey then turns around and shoots cop. It happens alot, these people put their lives on the line daily they LIVE every day knowing that if they are not on their guard the next stop could be their last.

#3 She further resists by getting back in the car, refusing to get back out of the car until pulled out, and then trying to get back in the car.

How does the cop know she doesn't have a gun?

How does the cop know she is not going to run with the kids in the car?

She started being a PITA from the moment she was pulled over, and esclated the situation herself. She placed herself in that position.

You can hate cops all you want, when your truck is stolen, when your house is being broken into, when you family member is hurt, kidnapped, or worse, you will want them to be there, putting their lives on the line for you. And they will.

sorry, that video AND the woman's narrative make me feel that she is 100% in the wrong

when you are pulled over, you make no sudden moves, keep your hands in clear line of sight, and follow the officers directions

are police ALWAYS right? No, they are human and make mistakes. But don't put yourself in the situation that YOU might become the mistake everyone else is discussing on the news and the internet forums
