Anyone used the suspension of HOS rules yet?

    I was hoping to learn if a load that I may be under would qualify for HOS waiver. What determines that. My discretion (probably not) or some official piece of paper. If I can use it, why not?

    An official piece of paper that accompanies the bol. Once delivered. Regular hos resumes.

    The only load I did like that was cable back when the ice storm hit and it was printed ON the BOL/POD.

    So it is known, that you can drive as long as you want with a Covid-19 relief load, provided that you are not fatigued. Then, after the completion of the load, if the HOS would have been otherwise violated, you are required to take 10 hours break.
    This was clearly explained in the FMCSA frequently asked questions regarding Covid-19 relief loads, if using HOS exemption.

    Question: I have this relief load booked for tomorrow morning and I'd rather drive towards the shipper as close as possible, even arrive at the shipper site, ready to load ASAP.
    If followed standard HOS, I would not be able to do it, without taking at least 8 hours in the sleeper.

    At what point do you start being HOS exempt, assuming that you were already dispatched for a relief load?
    Is it from the very assignment of the load? I mean, is the deadhead to the shipper also a part of the relief load trip, which is HOS exempt, or only after you are loaded?

    I tried to find that in the FMCSA guidelines but I did not find such a scenario.

    Well, I've not found anything either. My advise is always going to be play it safe and stay where you are. Now that said, we can look at other guidance by FMCSA. Specifically the guidance about the 150 air mile ag exemption. That guidance specifically states it exemption applies when going to pick up the exempt load.
    Now I'm not going to say it applies, but I'm also not going to say it doesn't.

    I am thinking, since even you have not found anything there;) It is probably another grey matter open for interpretation.
    I agree, it is best not to leave it for a leo to interpret on my behalf.

    So when does this Covid-19 HOS exemption end because I just got one of those loads? I thought it was over by now. 17 driving hours a day!? Hmmm.

    If you are hauling any of these the exemption has been extended until July 14.
    • Livestock and livestock feed.
    • Medical supplies and equipment related to the testing, diagnosis and treatment of COVID-19.
    • Supplies and equipment necessary for community safety, sanitation and prevention of community transmission of COVID-19, such as masks, gloves, hand sanitizer, soap and disinfectants.
    For everything else:
    “FMCSA has concluded that there is no longer a need for emergency relief with respect to the other categories of supplies, equipment and persons covered by the May 13 extension and expansion of Emergency Declaration No. 2020-02, and those categories are therefore no longer covered.”

    FMCSA extends emergency hours-of-service waiver until July 14 - Land Line
