Swift is heartless

    In Mar07 while working for Swift I was sitting on the side of a highway in Michigan. A driver from C-Mac Trans lost control of his vehicle and hit me while I was in my sleeper. I suffered two herniated discs in my back and one in my neck. A closed head injury that affects my memory to this day, as well as nerve damage in my arms and fingers that cause me to experience numbness. Can you believe Swift still hasn't paid me a dime in Workmen's Compensation? Over 2 and a half yrs have passed and they haven't paid any of my doctors or me. To make matters worse they only offered me $40,000 over 4yrs. These people deserve to rot in hell. I'm sure those responsible will be held accountable one day.     Was this determined to be a Preventable or Non-Preventable accident? Why were you sitting on the side of the road? Broke down? Ten hour break? Did you have your triangles out? Hood up? What was the results of the police report? Safety committee?
    Need more info please.

    Workman's comp. is not paid by the company you work for, it's paid by the state the injury occured in or your state of residence, I'm not sure which. In any case you need to file a claim usually done through the company HR department on your behalf. No claim, no case, no payment.

    Sounds like you need to follow the advice of one of last
    responders here, and go fetch the forms and fill them out.
    You waited two years?!!! Not to mention the pain you're in,
    or have suffered in the past. Dang!


    Unless you know you were really negligent, and doing something
    you shouldn't have done, you need to go lawyer up and go after

    Does swift have a Sitting duck rule(no parking on roadside)? If so they will fight you to the end.

    unless this was an emergency, and when i say emergency i'm talking about 4-ways on, triangles out, clearance lights on and everything but a couple of belly dancers out to warn passing motorists that you're parked on the side of the road, this was preventable. The ONLY reason to be parked in an emergency lane is for....er......an emergency. Parked to take a rest, or check your maps, or to fix yourself a peanut butter and jelly sandwich isnt cause to be parked in an emergency lane. It is not a parking lot, it isnt a truck stop, it isnt even a driveway. When my QC beeps, I dont even pull off and down an off/on ramp to park to check new messages. If i'm rolling, i'll pull off into the next rest area or truck stop. If you park in an emergency lane and dont have an emergency (regardless if you put your triangles out or not) you deserve everything coming to you.

    Was everything REASONABLE done? I'm guessing from the lack of response from the OP....it wasnt.

    but yes, we need more info.....doubt we'll ever get it.

    IF he was parked along side of the road for a non-emergency, that is irrelevant. He could have lost control and the driver might still be on the road today.....had he never been parked illegally (maybe)

    Workers comp in Florida pays your expenses even if you are screwing around (horse play.)

    Probably the same everywhere. Even if the employee is violating policy the company pays.
