This verdict will not stand. But even a verdict one tenth , $41 million is totally uncollectable. This type of thing is for the public consumption, but it does enormous damage to any business, not just trucking.
Just ask Textron, manufacturer of Cessna aircraft and the general aviation industry. Almost non existent because of this stuff.
Another Nuclear Verdict-$411 MILLION DOLLARS!!

Studebaker Hawk Thanks this. -
Maybe its because I was raised to get ahead in life honestly and earnestly but this sort of thing is beyond stupid. Fair is fair, cover the guy's expenses, any ongoing care required and get him a new bike.

The ironic aspect of the verdict is that the number will never stand.
Yeah, they feel good about helping the injured party, while screwing the big bad trucker.
They miss the mark that the trucker will declare bankruptcy, the injured party will only get insurance payout and whatever other meager balance of the company checking account is left, and it's done.D.Tibbitt, Gearjammin' Penguin and Studebaker Hawk Thank this. -
Love that Florida homestead law, though. Homesteaded homes are judgement-proof. Plus, you get an exemption on part of the property taxes.

You will also notice that Attorney Ben Crump is showing up in many of these wrongful death lawsuits and PI lawsuits involving Black persons. Even tho the High Dollar figures won't stand up, he will get a big payday when they do settle for a lesser amount when the appeals are entered.

I think that, if they want to go beyond actual damages and sue for everything a man or company is worth, then the legal standards need to also be escalated - if they want that absurd payout, then they ought to have to prove that the victim was operating in a safe and lawful manner, is not guilty of anything which they are accusing the defendant of, and wasn't doing anything [aside from presence] to aggravate the circumstances which led up to the wreck.
