Caught my carrier photoshopping rate cons and stealing money, what should I do?

    I'm leased onto a carrier, my contract is i get a % of the rate confirmation.

    Today when I arrived at shipper I was told surprise information about the load and we had a disagreement.
    I said I was not told this particular information about this load AND it's not in writing on the rate con.
    Customer with broker on speaker phone said we communicated all this with your driver manager and it is all in writing on the rate con.

    I said no I have rate con right here and what you are saying is not on here.

    Customer immediately went to computer and printed out rate con sent directly to my carrier to show me.
    It was then both I, customer and broker realized my carrier photoshopped the rate con sent to me to withhold information about the load from me.
    It gets worse, they also photoshopped the amount the broker is paying my carrier.
    Not a little bit either, a lot.

    I am soo pissed off and now wondering how long money has been being stolen from me.

    Any ideas on what I should do? Besides simply quitting.
    My concern is that being the carrier is doing these terrible things and acting this unethical that if I confront them they may try some more shady stuff like refusing to pay me loads I've done or keep my escrow account money if I leave.

    What's the best approach in handling a situation like this?

    You can sue, but it'll cost you about $15 to 25K to go through discovery and all the BS to get to court. And then, if you win, you get to try to collect.

    It is fraud. You can file a criminal complaint against them.

    I've heard of a guy that got burned real bad in a business deal where the offending party was unwilling to own up to their actions and ironically had the majority of his fleet go down for repairs.

    The guy who had been taken advantage of never did get paid what he was owed but he did get a truckload of used oil out of the deal.

    Tell your carrier you have a financial emergency and was wondering if they could pay you all the money they owe you. Be nice.
    Even if you need to take 3-5% less to get your money. Then quit if you chose. Better to sue for a lesser amount.

    Be nice most of all.
    Don't tell them what you have learned.

    You can always request the paperwork after you leave. You can request ratecons from the brokers and compare to your copies to verify the amount you should have received.

    You can sue for all shortages at this time.
    I would contact an attorney at least for guidance.

    Gotta wonder if they are changing the rate con.
    There is an extra middle man that most o/o's don't have.
    We have Shipper -> Broker -> Carrier -> o/o.
    The shippers rate con was to the broker. What was the rate con between the broker and carrier? Must likely that's the one the op got.

    Of course I could be wrong, and if so the only recourse is to sue.

    It's a small company, under 50 trucks.
    Not saying yet until I figure out what I'm going to do.
