You don't think those "Chicago Russians" haven't been threatens by lawsuits by at least 1000 of their drivers in the last year??? They don't give a $#!+. They are scumbags and work around the fringes of the law. They would just laugh in your face, (maybe worse), if you threatened them with a lawsuit. Really don't think they are the kind of people to eff with. Yes......I think the majority of them are of the "criminal element".

You absolutely right about law suit ...if the company over 20 trucks , they will care because it will hurt . 5-7 trucks - next week they will have another authority active . Scumbags - true , criminals - no , once you punch them in the face they will run away to the police , criminals usually work different :)!
There are good companies here but its like finding needle in the haystack . Dont mean to advertise but i pay consistently 1099 though , if you want w2 -less in your pocket cause i need to pay payroll lady .

If anyone is going to work for a 1099 company. You need a business account and open up an LLC. Prepay your quarterly taxes.

A 1099 gig is a “subcontract” employee. You’re a contractor so if you hop on the truck without a paper stating how much money they will pay you every week, with no signature, then you have invited the short end of the stick. How is a judge in court going to look at your situation without a verifiable contract? You have the walls, you have the roof, where’s the floor? This is how the 1099 companies take advantage of people.

If all the banks denied you from opening up an account (you messed up your life for some reason), then have the carrier agree to write you a check every week or get paid in cash. Everyone hates Walmart for some reason but they’re one of the few places left where you can cash a check.

Threatening to take them to court won't frighten anyone and you'll just sound like a nut. Throwing around legal vocabulary you don't understand and picked up in a Google search 2 hours ago isn't frightening. It's amusing.

O.P. should cut her losses and have higher standards for potential employers.
