Absolutely disgusting. I hope the trucker sues the family for 42 million for mental anguish, and his own pain and suffering. It says the car careened off an embankment and went under the trailer, leaving the kid completely at fault, but yet the trucking company and trailer manufacturer get penalized for not having underride safety equipment WHICH ISN'T REQUIRED ON THE SIDES because a car shouldn't be going under a trailer at all anyway. The only time I can see a truck at fault for an underride is if the truck driver ran a red light or stop sign. I can't think of any other scenario where a car would end up under a trailer.

Trucking company and Utility can readdress family to FMCSA and DOT for the award. Trucking company operated equipment manufactured in conformity with FMCSA and DOT safety rules.
