No, 5 watts will not hurt you. 100 is not too likely to do much damage, even over an extended period of time. But the days of guys running 100 watt linears behind their 5 watt CB's are over. 30 years ago, when I was an active CB'er, folks who ran 250 watts were rare, now, it is not uncommon for guys to run DX1600's and so on. My comments were directed at them. They have little or no clue the potential damage they may be doing to themselves.

It won't let me post a link here, but, if you refer to the support section of the IcomAmerica website, in the download database, you will see the list of the USA Amateur Bandplan. It will explain what are the frequencies allocated to the amateur service. 10 meters starts at 28.000 mhz, and goes up to 29.700. ANY frequency within that spectrum, IS an amateur frequency and thus you are not
"spilling into" the ham bands, rather you would actually be transmitting on a frequency allocated ONLY to CB.

Also, to clear up another thing. I see that someone posted a very informative and explanatory post regarding why it IS legal to modify a CB to use on the ham bands, but it is NOT legal to do the reverse. But, there was one piece of misinformation in there. Granted it is NOT likely to EVER come into play, bu it is a fact. A licensed ham, in an emergency may transmit on ANY frequency, which is likely to result in more reliable communication to assist in that emergency. INCLUDING on public safety, CB, Land Mobile, etc. Also, there is the Military Affiliate Radio Service (M.A.R.S.), which hams can also be licensed in, and they may use their modified ham radios in that service. Being such, it is NOT illegal for a ham radio to be capable of transmitting on a frequency it is not supposed to be used on, under normal circumstances. And, we, as a community, are intended to be self policing, and we know we are not supposed to go outside the allocated bands, and thus, typically, do not.
Now, is it likely that a CB is the mnost efficient form of emergency communication, NO, but IF it happened to be, it is legal for that ham to do so, and therefore, it is not illegal to have the radio modified, giving it that capability. It is only illegal to use it on those frequencies, without there being a bonafide emergency, where that is the most efficient form of communicating needs to emergency personnel.

    TRUE HOWEVER .....

To be used for that emergency the rules are quite limited 97.405 is one of the rules that applys bottom line is if life is at stake your 100% right .....
HAMS should note also that this must be the only way to obtain help C-Phone ect must not be useable ....... again a ruling by the FCC

It is LEGAL NO QUESTION for a HAM to mod any radio on to a ham band if it meets the emission allowed for that band. IT IS ILLEAGAL for a CBer to do any mods to his radio HOWEVER if he/she can show a life was in danger although not covered directly in part 95 there is no way the FCC would object.

This goes back to the early days of radio in all services.
