Hi,
New to this site and to trucking so I'll make this short and sweet. Got fired. Short enough? Reasons given are 3 service failrues in 6 months 1 valid I did in my 2nd week driving. 2 was CSR's choice after I accepted load and said sent back short on hours (from 70) this was 6 weeks into driving. and last one was the same CSR's choice. I'm sure it was just coinsidence that the CSR got in trouble for pushing my availible time to drive back 3 days when I refused to drive illegaly.
More important I've been accussed of a accident that happen 6 months ago that they are just now bringing up that is a complete fabrication. Should I get a lawyer involved that I can't afford or spend the $170.00 on the "Clean you DAC" site if that even works.
Any ideas would be appriciated. Thanks,

You can talk to an attorney, but to clear your record of the accident is going to cost to a few hundred bucks. I believe that you should get the accident off your record if it's false.

DEMAND from them the accident reports that have YOUR signature on them! Also police reports with YOUR signature on them THEN demand to see the safety review the company did with you sitting in the room with YOUR signature on it! OR find out where this "accident" happened (date and time) and contact that police department for any accident report concerning your tractor number trailer number and your drivers license number!
Call the safety dept daily! Piss them off to where they WANT to give you that information! JUST BE POLITE! That pisses them off even more! Also tape every phone conservation. NO you DO NOT have to tell them it's being taped as only 1 person needs to know and that's you and it's not being used in a court of law, just for your lawyer when you finally do call one!
Do this before you get a lawyer involved and waste a bunch of cash you probably don't have!
If I understand you correctly you got Swifted? This bottom feeder does this a lot as you will see in the forums!
I hope you are close to a terminal so you don't have to travel to far as writing will probably not do you much good! I'd walk into the phoenix yard and start there!
If not then stat with return receipt requested receipts through the US Mail and send it to whoever is the head of the safety department. In your letter put the proper headers on the letter and be POLITE be concise and tell them exactly what you need from them concerning your safety record as it is YOUR record. Do not threaten them with a lawyer or an arse beating! You just want to see what they are putting on your DAC and the PROOF!
The accident report is what you really want. Any and all information about this "accident"is all you want as the other BS late loads #### most "upstanding" companies will over look and you can contest those through HireRight's website with just a few clicks! But the accident you need to cut off period! DO NOT knuckle under to Swift as they are not worth the sweat off of a good trainees arse! Just get the accident information and if they refuse even to give you the city name where the accident happened THEN sic a lawyer on them!
Just remember they have a tad bit more money than you do BUT a good lawyer with $$ signs in his eyes can give them trouble they don't need! Just make sure said lawyer knows you get 66% of the 100% he gets!
Also check with OOIDA about a lawyer in your area that can handle this kind of job!
