who should pay

    New to the Dump truck business we are on a job 2nd tier sub contractor the first tier contractor sent our driver out and the main contractor had him dry hauling all day But did not tell us it was pay by ton and 2nd tier contractor said we should have told driver not to do that.. but we send our driver to you and you tell him what to do so how we know he was dry hauling.. he was on 1 project they told him to stop and go to the next spot. We had to still of course had to pay driver which is by hr. And we get a certain price by hr.. from 1st tier contractor.. But they did not pay us for the dry hauling. they said that was on other people. and they had our driver doing it for 2 days before saying something to us.. who should eat that bill us?

    The 1st tier of course is saying they are not getting paid (if they are not) for that work. If the main contractor is honest, I believe & hope they will compensate you for the work. I would take it up with the main contractor if he was not paying the 1st tier. I do find that would be suspect because the main would be dealing with the 1st tier far as compensation for work being done. You will find out for sure. I hope it all goes well for you

    Going forward I'd be asking your driver to notify you on a daily basis with what they've got him doing and if anything changes.

    This probably could've been nipped earlier if there was more communication.

    Never work for the 1st tier guy again if he refuses to pay the hourly. Did your driver write down all his moves on a ticket and have the contractor sign it at the end of the day ?
