Company wants to change my off duty time to sleeper berth so I can drive after 8

    Company wanted me to relay a load. I logged off duty for my 10 hour break. Phone started ringing after 8 hours and 11 minutes. They called me 7 times in 3 minutes. Ahole night dispatch suggests he can change my off duty time to sleeper berth time in order to make me legal.

    Wouldn't this be falsification of my logs? To make a long story short I had only slept for maybe 4 hours and was no where near ready to roll. Now I'm sitting in my sleeper at the pilot pissed off and unable to sleep.. this seems to be a standard industry wide.. we arent people anymore.. just another butt in the seat.

    Were you in the sleeper? If so, logging off duty is the falsifying of logs ..

    As for the company simply turn off the phone or reply you are too fatigued to drive right now.

    If you were in your sleeper, it isn’t falsifying your log to change it to sleeper berth.

    I run eld, and it automatically logs driving and on duty time based on what the truck is doing...ie parked or rolling.... but I control off duty and sleeper berth logging.
    I'd be pretty pissed if someone altered my logs, and likely go after them for it.
    I download my weekly logs and email them to myself records.
    In your instance, I think you have a couple options....
    There is a provision for split sleeper 8 and 2, or 7 and 3.
    But, as you said, you're not feeling like you're safe to operate, which trumps all.
    It's your cdl, protect it.
    Altering logs is bad karma without solid justification.
    Dispatch needs don't make that list in my opinion. If a load is so mission critical it calls for breaking the hos rules, someone higher up screwed the pooch and failed to plan properly.

    My company would never change our logs. We have to edit them ourselves if we make mistake. We also don't do overnight runs and almost never have to relay or save a load from another driver. I only had then one time tell me to go to sleep in afternoon and get up say midnight and drive all night. We haul dry van so most places are only open during daylight.

    They should no be calling and waking you up if trying to sleep. Sounds like dispatch wanted driver to do split sleeper vs full 10 hours off. That would be only ready to change logs.

    A. Turn the ringer off and do not answer the phone when your off, sleeping or driving.
    B. Tell them NO!

    How are they supposed to communicate with the driver? Get Eta, plan next trip, warn about appointment changes e. t. c?
    For the night you can put the phone in Do Not Disturb mode, but during the day driver should just a Bluetooth device to answer phone calls

    How did you only sleep 4 hours after being off duty already for 8 hours?

    Get in the habit of putting your phone in airplane mode when you go to sleep. And I don't want to hear about "emergencies." Thats what 911 is for - what are you going to do from the cab of a truck?

    I always use sleeper berth in case I need to do a split. I'm physically in the sleeper so the logs are correct.

    Wondering the same thing. He had two hours left on his reset. But you don't wake up after ten hours, you wake up early to brush your teeth and get ready for the next part of the run. So was he looking at another hour of sleep at best anyway? What is really the difference between four and five hours of sleep? Eight hours off and you can't drive, even though it would be legal to do so? Seems more like a "won't" than a "can't".

    I guess there's some merit to the guys on this site saying: "when you hire drivers, never expect them to work for you as hard as you work for yourself."

    But with all that said...#### forced dispatch. Maybe I feel this way because I don't have a boss.
