Protecting your CDL

    No, you told him to take it up the backside. All having a "firm no" will do is get ignored by these types of companies. They will not back down and they will keep scheduling impossible loads. The only options are to either run illegal which will have a negative impact on ones driving record, or quit.
    If he stays he'll keep getting load after load that's illegal and once he does finally quit they will try and claim he abandoned the load or something of that nature.

    A leopard will never change it's spots and all that....

    So I went to the company yard today to speak with the boss. He lied right to my face and said I never told you to drive over your hours even though he clearly told me on the call that night "just help me out this one time brother".

    He also told me you are allowed to drive under personal conveyance in Canada with a loaded trailer (for you American drivers you can move a loaded trailer under PC like normal but in Canada you cannot drive under PC with a loaded trailer.

    Long story short we had a very heated argument about it and I collected my last cheque and that's the end of that. I know sooner or later the rules do get bent, I have only done it a handful of times in the last 2.5 years. I will bend the rules any day for the week on paper logs but never on ELD. I had 3 violations in one week of driving, if I got pulled into any scale I would have had those tickets on my record for 3 years.

    I don't have any regrets anymore, I feel like I did the right thing.

    Yeah, you did the right thing. It sucks to lose the income and have to search for another job, but it would suck a hell of a lot more if you get that on your record. And like someone said above, you'd be thrown under the bus in a heart beat. Run legal, run safe. All else will fall into place.

    Just being pedantic, and only a FYI...
    In the US, you can move a loaded trailer. You cannot, however, advance the load in any way (with a couple of exemptions, like all the HOS regulations....). It was changed to allow stuff like box trucks to use PC just like a bobtail tractor can.

    Whoops just for clarification I meant you are allowed in the US but not allowed in Canada to move a loaded trailer under PC. My wording was kinda bad with that. Edited.

    The bad part about this job is this, "Everything is on the driver". There is no way around that, drive too many hours and get caught, the driver is going to pay the fine. Don't do a pre trip and get inspected, the driver is going to get the fine and CSA points. You, the driver are bag holder for everyone else trying to parasite off of you.

    It is the driver that makes the decision on running his truck.
    If you drive too many hours and get caught it is on you. And it should be. Even if pushed by the company, it is the driver that decides to run illegal.
    Don't do a pre trip and get inspected? Why shouldn't the guy that couldn't be bothered to pre-trip his truck be the one to get the fines and points?
    You, the driver, won't have these problems if you bring your "A" game to work with you everyday.

    CSA points go to the carrier, not the driver. The PSP system for the driver has no points associated with it, it will only show violations found during an inspection.

    That’s why you should record all your calls with dispatch.

    i always recorded every phone call with the company.
    Because there is no way they would ever ask you in writing on the Qualcomm or in a text message or email to run over hours ,

    no legit company would ask you to do it even on the phone .

    and you gotta learn to just tell them “I don’t have the hours to complete that trip”

    Good you cleared it up with him. You are absolutely correct, cannot PC loaded trailer in Canada.
    Personal conveyance is for personal use. Otherwise it would be called DD, Dispatchers Discretion.
