    One more point! You CAN NOT use HIPAA with the physical forms. There are many exceptions to this rule and regulatory compliance is one of the major ones! Also, HIPAA only generally applies to medical providers. A carrier can and some WILL round file your application if you refuse to disclose most safety-related data.

    Years ago I was leased to a carrier who thought I needed to go thru the hoops like the company drivers.
    I went and got my physical and gave them a copy of med card. They didn’t want to accept it because I didn’t go to their quack and well, I went on my merry way.
    I followed the regulations. But their MC#.
    so #### ‘em plenty of carriers out there who don’t want your life history or try to

    Long form fine, cpap data shouldnt even exist.

    I dont care if its legal or even fmcsa recommended and insurance required for the company to ask for it, it is simply wrong, it shouldnt be a thing that your company wants full logging data on you in your offtime.

    And anyone complying with such a request in a drivers market is simply enabling more draconian behaviour in the future.

    My statement is NOT about legality, its a recommendation to not seek safety and security at the price of liberty

    coulda, shoulda, woulda, There are thousands of things that I don't like in this industry. Some things I think should never be allowed and some things that are not allowed should be. The problem is it is an opinion. How many times do I have to say this? If a carrier asks for CPAP compliance data and you refuse to provide it MOST LIKELY you are not going to be driving much longer for that company!

    I've said my peace and suggest contacting the closest FMCSA service center and telling them it is wrong! I am sure somewhere they have the world's smallest violin to play for you! For now, I'm done with this silly discussion!

    Thanks for your reply, I know you said you don't feel well.

    I don't see anything in the regulations you posted that specially says I have to provide the form that I have to fill out with all my medical information to the carrier. It just says that the medical examiner must provide the person examined with a certificate in the form outlined in paragraph H. It also specifies that they have to provide the certificate to the carrier at request.

    I don't see where it says you have to provide the forms that you fill out with your private medical conditions to your employer.

    It's not an issue for me at this time as the employer that tried to force me to fork over my medical records was only a seasonal winter job. They did not pay for the physical, my normal job payed for it and they don't even ask for a copy of my card. I was already pretty fed up with them due to them shorting my paycheck. The confrontation happened just as I was starting in November for the season, they let me work the entire season and did not bring it up again.

    I was going to go back and work for them again the next season but they cancelled on me last minute, not sure if that refusal had anything to do with it. I haven't worked for them since. Screenshot_20211108-191842.png

    Yes, I don't feel good and I am in a really bad mood. But am having to do some other work and am catching up some on these boards as I wait to get finished. As to the other thing all I can do is provide you this information and give the advice to Contact your closest FMCSA SERVICE CENTER!

    If your medical card is cleared based on compliance of using the CPAP. Of course the carrier has the right to verify that you are using it. Otherwise your card is invalid.

    The only reason someone would not want to give this information is if they weren't using it.

    So suck it up. Put on your big boy pants or find another company.
